The adoption of administrative procedures in global governance has the potential to foster proper consideration of marginalized actors’ interests, yet risks entrenching the dominance of the well-resourced and powerful. Accordingly, this book proposes a new framework for evaluating the extent to which administrative procedures in the compliance systems of multilateral environmental agreements constrain power and promote regard for the interests of affected states, which are frequently developing and transition countries. This framework is applied to the compliance systems under the Montreal Protocol, the Kyoto Protocol and CITES, which address critical global environmental issues of ozone-layer depletion, climate change and trade in endangered species, respectively. The analysis shows that, under certain conditions, administrative procedures limit the influence of states’ asymmetric power on compliance deliberations. Furthermore, systematic adoption of these procedures increases the opportunities for affected states’ interests to be voiced and considered in compliance decision-making processes.

Originally published in 1996. The Montreal Protocol on Substances that Deplete the Ozone Layer is one of the most effective multilateral environmental agreements currently in existence. Established to control the production and consumption of CFCs and other ozone-depleting chemicals, the Protocol is an important example of an agreement which places restrictions on international trade in the interests of the global environmental – a feature which may become common in future treaties. This report examines the development, effectiveness and future of the trade provisions of the ozone regime, concluding that they have contributed significantly to its success in attracting signatories and in limiting ozone depletion. Issues considered include the compatibility of the trade provisions and the GATT, trade restrictions and developing countries, and the new problems of non-compliance and illegal trade in CFCs.

This book proposes a new approach to differentiating between developing countries in the context of special and differential treatment (SDT) in the World Trade Organisation. Offering unique insights into SDT reform in the WTO, the book proposes the method of differentiated differentiation and demonstrates its operationalization using the WTO Customs Valuation Agreement. Through identifying key indicators to categorize constraints faced by developing countries, the book establishes objective criteria to depoliticize access to SDT. Promoting a case-by-case approach, the book also employs a statistics-based score procedure to determine a threshold for graduating countries out of SDT. Through flexible tracking and evidence-based arguments, the book provides a transitional method of reform which maintains full compliance with WTO members’ obligations.
