The future of Nordic labour law: Facing the challenges of changing labour relations

These questions form the backdrop for the analysis in this report. The Nordic systems of labour law are built on a binary divide between employees and the self-employed. As a main rule, employees are protected by labour law, while self-employed are not, and the employer is responsible for complying with the legal framework. If future labour relations make it harder to assess whether a worker is an employee or self-employed, and to decide who is the employer, this might undermine the efficiency of labour law regulations. The report analyzes the adaptability of the legal framework, and points at strengths and weaknesses. Furthermore, the study discusses how the identified challenges can be addressed, by suggesting avenues for legal development and reform. The report is the concluding analysis of Pillar VI in the project Future of Work: Opportunities and Challenges for the Nordic Models (NFoW), funded by the Nordic Council of Ministers.

Migration to and from Welfare States

This open access book explores the role of family, public, market and third sector welfare provision for individual and households’ decisions regarding geographical mobility. It challenges the state-centred approach in research on welfare and migration by emphasising migrants’ own reflections and experiences. It asks whether and in which ways different welfare concerns are part of migrants’ decisions regarding (or aspirations for) mobility. Employing a transnational and a translocal perspective, the book addresses different forms of geographical mobility, such as immigration, emigration, and re-migration, circular and return migration. By bringing in empirical findings from across a variety of Western and non-Western contexts, the book challenges the Eurocentric focus in current debates and contributes to a more nuanced and more integrated global account of the welfare-migration nexus.




Collective Agreements


Book Description

Collective bargaining involves a process of negotiation between one or more unions and an employer or employers' organisation(s). The outcome is a collective agreement that defines terms of employment - typically wages, working hours and in-work benefits. The agreement affords labour protection: minimum wages, regular earnings; limits on working hours and predictable work schedules; safe working environments; parental leave and sick leave; and a fair share in the benefits of increased productivity. The International Labour Organization (ILO) Collective Agreements Recommendation 1951 (No. 91) considers, where appropriate and having regard to national practice, that measures should be taken to extend the application of all or some provisions of a collective agreement to all employers and workers included wthin the domain of the agreement. The extension of a collective agreement generalises the terms and conditions of employment, agreed between organised firms and workers, represented through their association(s) and union(s), to the non-organised firms within a sector, occupation or territory. The collection of chapters in this volume are about the extension of collective agreements as an act of public policy.

This book deals with international labor and employment law in the East Asia Region (EA), particularly dealing with China, South Korea and Japan. It explores and explains the effects of globalization and discusses the role played by international labor law as it affects lawyers, business, labor, labor unions and human resource management, and the labor issues that can arise in dealing in EA trade and investment. The text, and the readings (from area experts), are organized and written to provide the reader with, first, a broad understanding and insight into the global dimensions of the fast-emerging area of labor and employment issues (e.g., global legal standards and their interplay with domestic and foreign laws); and second, to show how these laws and approaches play out in specific EA countries (comparing global approaches with the specific laws of each country on four common agenda items: regulatory administration, workers' rights, trade unions and dispute resolution).
