The authors of the studies on the Mishnah collected in the present volumes represent the best of contemporary scholarship on that document. In the past thirty years, the Mishnah seen as a document on its own terms has taken its place as a principal focus in the academic study of religion and of Judaism. Many university scholars have participated in the contemporary revolution in the description, analysis, and interpretation of the Mishnah. Nearly all the publishing scholars of the academy (as distinct from the yeshiva or rabbinical seminary) who are now at work are represented in this project, ultimately planned for three volumes. In this and the companion volumes, the editors place on display a broad selection of approaches to the study of the Mishnah in the contemporary academy. What they prove in diverse ways is that the Mishnah defines the critical focus of the study of Judaism. It is a document that rewards study in the academic humanities. Because many viewpoints register here, this is the most representative selection of contemporary Mishnah-study available in any state-of-the-question-collection in a Western language.

Akiva Cohen investigates the general research question: how do the authors of religious texts reconstruct their community identity and ethos in the absence of their central cult? His particular socio-historical focus of this more general question is: how do the respective authors of the Gospel according to Matthew, and the editor(s) of the Mishnah redefine their group identities following the destruction of the Second Temple? Cohen further examines how, after the Destruction, both the Matthean and the Mishnaic communities found and articulated their renewed community bearings and a new sense of vision through each of their respective author/redactor's foundational texts. The context of this study is thus that of an inner-Jewish phenomenon; two Jewish groups seeking to (re-)establish their community identity and ethos without the physical temple that had been the cultic center of their cosmos.

The first five books of the Hebrew Bible contain a significant number of texts describing ritual practices. Yet it is often unclear how these sources would have been understood or used by ancient audiences in the actual performance of cult. This volume explores the processes of ritual textualization (the creation of a written version of a ritual) in ancient Israel by probing the main conceptual and methodological issues that inform the study of this topic in the Pentateuch. This systematic and comparative study of text and ritual in the first five books of the Hebrew Bible maps the main areas of consensus and disagreement among scholars engaged in articulating new models for understanding the relationship between text and ritual and explores the importance of comparative evidence for the study of pentateuchal rituals. The death penalty in classical Judaism has been a highly politicized subject in modern scholarship. Enlightenment attacks on the Talmud's legitimacy led scholars to use the Talmud's criminal law as evidence for its elevated morals. But even more pressing was the need to prove Jews' innocence of the charge of killing Christ. The reconstruction of a just Jewish death penalty was a defense against the accusation that a corrupt Jewish court was responsible for the death of Christ. In Execution and Invention, Beth A. Berkowitz tells the story of modern scholarship on the ancient rabbinic death penalty and offers a fresh perspective using the approaches of ritual studies, cultural criticism, and talmudic source criticism. Against the scholarly consensus, Berkowitz argues that the early Rabbis used the rabbinic laws of the death penalty to establish their power in the wake of the destruction of the Temple. Following recent currents in historiography, Berkowitz sees the Rabbis as an embattled, almost invisible sect within second-century Judaism. The function of their death penalty laws, Berkowitz contends, was to create a complex ritual of execution under rabbinic control, thus bolstering rabbinic claims to authority in the context of Roman political and cultural domination. Understanding rabbinic literature to be in dialogue with the Bible, with the variety of ancient Jews, and with Roman imperialism, Berkowitz shows how the Rabbis tried to create an appealing alternative to the Roman, paganized culture of Palestine's Jews. In their death penalty, the Rabbis substituted Rome's power with their own. Early Christians, on the other hand, used death penalty discourse to critique judicial power. But Berkowitz argues that the Christian critique of execution produced new claims to authority as much as the rabbinic embrace. By comparing rabbinic conversations about the death penalty with Christian ones, Berkowitz reveals death penalty discourse as a significant means of creating authority in second-century western religious cultures. Advancing the death penalty discourse as a discourse of power, Berkowitz sheds light on the central relationship between religious and political authority and the severest form of punishment.

If indeed such an early corpus did exist, what are its characteristics and what, if any, connection does it have with the parallel Palestinian collections? Was this Babylonian Mishnah created in order to harmonize the Palestinian Mishnah with a corpus of rabbinic teachings already existent in Babylonia?
