This book offers a normative reconceptualization of a modern Islamic governed state. First, Joseph Kaminski surveys the historical context of the trajectory of Islamic thought, and offers a unique discursive framework for reconceptualizing an Islamic governed state that rejects secular Enlightenment liberalism and instead is heavily grounded in Ancient Greek ideals of politics and political leadership. Despite heavily borrowing from Greek thought, the model offered remains firmly rooted in a Shari’ah-based, discursive ontological framework. The volume explores topics of bureaucracy, law, democracy, women in politics, and economic justice. Further, this volume presents case studies from Turkey, Egypt, Tunisia, and Malaysia, and utilizes the presented theoretical framework as a lens for analysis.

The Politics of Islamic Law

In The Politics of Islamic Law, Iza Hussin compares India, Malaya, and Egypt during the British colonial period in order to trace the making and transformation of the contemporary category of ‘Islamic law.’ She demonstrates that not only is Islamic law not the shari’ah, its present institutional forms, substantive content, symbolic vocabulary, and relationship to state and society—in short, its politics—are built upon foundations laid during the colonial encounter. Drawing on extensive archival work in English, Arabic, and Malay—from court records to colonial and local papers to private letters and visual material—Hussin offers a view of politics in the colonial period as an iterative series of negotiations between local and colonial powers in multiple locations. She shows how this resulted in a paradox, centralizing Islamic law at the same time that it limited its reach to family and ritual matters, and produced a transformation in the Muslim state, providing the frame within which Islam is articulated today, setting the agenda for ongoing legislation and policy, and defining the limits of change. Combining a genealogy of law with a political analysis of its institutional dynamics, this book offers an up-close look at the ways in which global transformations are realized at the local level.

This book offers comparative ontologies of both Islam and liberalism as discourses more broadly construed. The author argues that, despite recent efforts to speak of overlapping consensuses and discursive congruence, the fundamental categories that constitute "Islam" and "Liberalism" remain very different, and that these differences should be taken seriously. Thus far, no recent scholarly works have explicitly or meticulously broken down where these differences lie. The author rigorously explores questions related to rights, moral epistemologies, the role of religion in the public sphere, and more general approaches to legal discourse, via primary and canonical sources constitutive of both Islam and liberalism. He then goes on to articulate why communitarian modes of thought are better suited for engaging with Islam and contemporary socio-political modes of organization than liberalism is. You will notice the new name of our journal, American Journal of Islam and Society (AJIS), that has replaced the older American Journal of Islamic Social Sciences (AJISS). Now in its thirty-seventh year, the journal has evolved along with the scholarly landscape and our global community of readers. The new name reflects an expansion of the journal’s scope, which has in fact already reflected in the articles it has featured for years. This change signals that social sciences and humanities are interrelated and that an Islamic engagement with one requires examining the other; we therefore wish to underscore that we welcome all scholarship that pertains to the myriad ways in which Islam and human societies interact.
