Bringing together leading scholars of Islamic politics, ethics, and law, this book examines the varied meanings and uses of Islamic law, so as to assess the prospects for democratic, plural, and gender-equitable Islamic ethics today. These essays show that, contrary to the claims of some radicals, Muslim understandings of Islamic law and ethics have always been varied and emerge, not from unchanging texts but from real and active engagement with Islamic traditions and everyday life. Anti-Veiling Campaigns in Turkey

The veiling and unveiling of women have been controversial issues in Turkey since the late-Ottoman period. It was with the advent of local campaigns against certain veils in the 1930s, however, that women's dress turned into an issue of national mobilisation in which gender norms would be redefined. In this comprehensive analysis of the anti-veiling campaigns in interwar Turkey, Sevgi Adak casts light onto the historical context within which the meanings of veiling and unveiling in Turkey were formed. By shifting the focus from the high politics of the elite to the implementation of state policies, the book situates the anti-veiling campaigns as a space where the Kemalist reforms were negotiated, compromised and resisted by societal actors. Using previously unpublished archival material, Adak reveals the intricacies of the Kemalist modernisation process and provides a nuanced reading of the gender order established in the early republic by looking at the various ways women responded to the anti-veiling campaigns. A major contribution to the literature on the social history of modern Turkey, the book provides a complex analysis of these campaigns which goes beyond a simple binary between liberation and oppression.

This book reconsiders the dominant Western understandings of freedom through the lens of women's real-life experiences of domestic violence, welfare, and Islamic veiling. Nancy Hirschmann argues that the typical approach to freedom found in political philosophy severely reduces the concept's complexity, which is more fully revealed by taking such practical issues into account. Hirschmann begins by arguing that the dominant Western understanding of freedom does not provide a conceptual vocabulary for accurately characterizing women's experiences. Often, free choice is assumed when women are in fact coerced--as when a battered woman who stays with her abuser out of fear or economic necessity is said to make this choice because it must not be so bad--and coercion is assumed when free choices are made--such as when Westerners assume that all veiled women are oppressed, even though many Islamic women view veiling as an important symbol of cultural identity. Understanding the contexts in which choices arise and are made is central to understanding that freedom is socially constructed through systems of power such as patriarchy, capitalism, and race privilege. Social norms, practices, and language set the conditions within which choices are made, determine what options are available, and shape our individual subjectivity, desires, and self-understandings. Attending to the ways in which contexts construct us as "subjects" of liberty, Hirschmann argues, provides a firmer empirical and theoretical footing for understanding what freedom means and entails politically, intellectually, and socially.

Bargaining for Women's Rights

Gender relations in Muslim-majority countries have been subject to intense debate in recent decades. In some cases, Muslim women have fought for and won new rights to political participation, reproductive health, and education. In others, their agendas have been stymied. Yet missing from this discussion, until now, has been a systematic examination of how civil society groups mobilize to promote women’s rights and how multiple components of the state negotiate such legislation. In Bargaining for Women’s Rights, Alice J. Kang argues that reform is more likely to happen when the struggle arises from within. Focusing on how a law on gender quotas and a United Nations treaty on ending discrimination against women passed in Niger while family law reform and an African Union protocol on women’s rights did not, Kang shows how local women’s associations are uniquely positioned to translate global concepts of democracy and human rights into concrete policy proposals. And yet, drawing on numerous interviews with women’s rights activists as well as Islamists and politicians, she reveals that the former are not the only ones who care about the regulation of gender relations. Providing a solid analytic framework for understanding conflict over women’s rights policies without stereotyping Muslims, Bargaining for Women’s Rights demonstrates that, contrary to conventional wisdom, Islam does not have a uniformly negative effect on the prospects of such legislation.

Women's traversal of public space in Islamic/ate societies and the ensuing process of negotiating gendered identities are the central concerns of this collection of essays. The dichotomy between private and public spheres, upheld as axiomatic for most societies, has recently been challenged by scholars as an artificial construct. For women in particular, the demarcation between the two spheres has become blurred by the enormous public consequences of their private behaviour.
