Pursuant to a legislative requirement, GAO reported on federal agencies' compliance with its recommendations in connection with bid protests decided during fiscal year (FY) 1986. It also provided information on its: (1) defense of the constitutionality of the Competition in Contracting Act (CICA); and (2) processing of FY 1986 bid protests. GAO reported that: (1) there was only one instance in FY 1986 where a federal agency failed to comply with its recommendations; (2) the Naval Facilities Engineering Command failed to suspend performance of a construction contract pending resolution of a protest; (3) a Court of Appeals decision upheld the CICA requirement that contract performance be suspended during a protest until the Comptroller General issues an opinion; (4) a Court of Appeals decision upheld the decision that CICA did not violate the separation of powers doctrine; (5) there were 2891 CICA cases filed during FY 1986; (6) it closed 2884 CICA cases within 31.3 working days; (7) protesters obtained relief in about 25 percent of the cases; and (8) it disposed of most withdrawn and academic cases in response to favorable agency action.
