The Life, Music, and Times of Carlos Gardel

Book Description

In the first biography in English of the great Argentinian tango singer Carlos Gardel (1890-1935), Collier traces his rise from very modest beginnings to become the first genuine "superstar" of twentieth-century Latin America. In his late teens, Gardel won local fame in the barrios of Buenos Aires singing in cafes and political clubs. By the 1920s, after he switched to tango singing, the songs he wrote and sang enjoyed instant popularity and have become classics of the genre. He began making movies in the 1930s, quickly establishing himself as the most popular star of the Spanish-language cinema, and at the time of his death Paramount was planning to launch his Hollywood career.Collier's biography focuses on Gardel's artistic career and achievements but also sets his life story within the context of the tango tradition, of early twentieth-century Argentina, and of the history of popular entertainment.

Ratio Decidendi

Book Description

Ratio decidendi is a technical legal term of art in Anglo-American jurisprudence, a concept opposed to the idea of obiter dictum. Ratio decidendi is the reason of the judge in coming to a judicial decision in a lawsuit presented to the court by the litigants for an official decision. Obiter dictum is whatever else a judge might say in passing. This concept of ratio decidendi operated very differently in the different nations of Western Europe and their former colonies at different periods of early-modern history as is demonstrated in the first volume (25/1) which was published in 2006.The second volume focuses on a specific aspect of ratio decidendi: the use by the courts of foreign law as the basis of their decisions when appropriate to the issues to be decided in a particular case brought to them by the litigants. The term foreign law refers to law that is not part of the law binding upon the court, in other words law outside the court's system of jurisprudence. Thus, one must consider what is domestic law in order to discern what is foreign to, or outside of, it. These comparative essays thus center on what law is foreign in various continental and Anglo-American legal systems from the Middle Ages until the 20th century and how it supports legal arguments and decisions.

Habermas and Contemporary Society

Book Description

Over the last four decades Jürgen Habermas has forged an innovative and much-discussed theory of contemporary capitalist society. Building on Max Weber's thesis that the dynamic of capitalism actually erodes individual freedom and the meaningfulness of social life - famously resulting in a culture of 'specialists without spirit, sensualists without heart' - Habermas traces contemporary social conflict to resistance to this dynamic by a variety of social groups. His theory of 'communicative action' attempts to show the possibilities in contemporary society for moving toward a more balanced social life that, unlike other political currents today, would not sacrifice the truly progressive features of complex modern societies. By marginalizing methodological and other more specialized theoretical concerns, this book focuses on Habermas's substantive portrayal of contemporary society and its discontents.
