'Law Books in Action: Essays on the Anglo-American Legal Treatise' explores the history of the legal treatise in the common law world. Rather than looking at treatises as shortcuts from 'law in books' to 'law in action', the essays in this collection ask what treatises can tell us about what troubled legal professionals at a given time, what motivated them to write what they did, and what they hoped to achieve. This book, then, is the first study of the legal treatise as a 'law book in action', an active text produced by individuals with ideas about what they wanted the law to be, not a mere stepping-stone to codes and other forms of legal writing, but a multifaceted genre of legal literature in its own right, practical and fanciful, dogmatic and ornamental in turn. This book will be of interest to legal scholars, lawyers and judges, as well as to anyone else with a scholarly interest in law in general, and legal history in particular.

Deliberation, in recent years, has emerged as a form of civic engagement worth reclaiming. In this persuasive book, Sandra M. Gustafson combines historical literary analysis and political theory in order to demonstrate that current democratic practices of deliberation are rooted in the civic rhetoric that flourished in the early American republic. Though the U.S. Constitution made deliberation central to republican self-governance, the ethical emphasis on group deliberation often conflicted with the rhetorical focus on persuasive speech. From Alexis de Tocqueville’s ideas about the deliberative basis of American democracy through the works of Walt Whitman, John Dewey, John F. In the 1949 classic Killers of the Dream, Lillian Smith described three racial "ghosts" haunting the mind of the white South: the black woman with whom the white man often had sexual relations, the rejected child from a mixed-race coupling, and the black mammy whom the white southern child first loves but then must reject. In this groundbreaking work, Robert H. Brinkmeyer, Jr., extends Smith's work by adding a fourth "ghost" lurking in the psyche of the white South -- the specter of European Fascism. He explores how southern writers of the 1930s and 1940s responded to Fascism, and most tellingly to the suggestion that the racial politics of Nazi Germany had a special, problematic relevance to the South and its segregated social system. As Brinkmeyer shows, nearly all white southern writers in these decades felt impelled to deal with this specter and with the implications for southern identity of the issues raised by Nazism and Fascism. Over the course of the twentieth and twenty-first centuries, Mexican American and African American cultural productions have seen a proliferation of upward mobility narratives: plotlines that describe desires for financial solvency, middle-class status, and social incorporation. Yet the terms "middle class" and "upward mobility"—often associated with assimilation, selling out, or political conservatism—can hold negative connotations in literary and cultural studies. Surveying literature, film, and television from the 1940s to the 2000s, Elda María Román brings forth these narratives, untangling how they present the intertwined effects of capitalism and white supremacy. Race and Upward Mobility examines how class and ethnicity serve as forms of currency in American literature, affording people of color material and symbolic wages as they traverse class divisions. Identifying four recurring character types—status seekers, conflicted artists, mediators, and gatekeepers—that appear across genres, Román traces how each models a distinct strategy for negotiating race and class. Frances Trollope

Long overshadowed by her more widely read and reprinted son Anthony, Frances Trollope is almost exclusively remembered for her travel writing and especially for the notoriously controversial Domestic Manners of the Americans. Her impressively prolific career as a writer, however, covered and transgressed several genres, and spanned the early 1830s right through until the mid-1850s. A contemporary of Jane Austen, Trollope wrote social-problem novels about industrial England and satirical exposures of evangelical Christianity, as well as writing the first anti-slavery novel. She was a controversial, yet popular and prolific, writer who lived on her works, while using them to vent her outrage at various social and cultural developments of the time. A reassessment of her position in nineteenth-century literary culture brings to attention her own versatility as well as the various ways in which the pressing issues of the time could be represented and, in turn, helped to form Victorian literature.
