Forging Alberta’s Constitutional Framework analyzes the principal events and processes that precipitated the emergence and formation of the law and legal culture of Alberta from the foundation of the Hudson’s Bay in 1670 until the eve of the centenary of the Province in 2005. The formation of Alberta’s constitution and legal institutions was by no means a simple process by which English and Canadian law was imposed upon a receptive and passive population. Challenges to authority, latent lawlessness, interaction between indigenous and settler societies, periods (pre- and post-1905) of jurisdictional confusion, and demands for individual, group, and provincial rights and recognitions are as much part of Alberta’s legal history as the heroic and mythic images of an emergent and orderly Canadian west patrolled from the outset by red coated mounted police and peopled by peaceful and law-abiding subjects of the Crown. Papers focus on the development of criminal law in the Canadian west in the nineteenth century; the Natural Resources Transfer Agreement of 1930; the National Energy Program of the 1980s; Federal-Provincial relations; and the role and responsibilities of the offices of Justices of the Peace and of the Lieutenant-Governor; and the legacies of the Lougheed and Klein governments.







The Counselling Speeches of Jim Ka-Nipitehtew


Book Description

Jim Ka-Nipitehtew was a respected Cree Elder from Onion Lake, Saskatchewan, who spoke only Cree and provided these original counselling discourses. The book offers the speeches in Cree syllabics and in Roman Orthography as well as an English translation and commentary. The Elder offers guidance for First Nations people in these eight speeches that cover the proper performance of ceremonies, words of encouragement for youth, information about collecting medicinal plants, directions for proper behaviour of men toward women, proper preparations for the Pipe ceremony, the role of the Pipestem in the Making of Treaty 6, the importance of tobacco, and examples of improper ritual behaviour in ceremonies. One of the most important speeches is the narrative of the Cree record for the treaty negotiations that took place in the summer of 1876. It was originally transmitted by Jim Ka-Nipitehtew's father directly to him and the authors comment on this remarkable chain of transmission. The book contains a Cree-English and an English-Cree Glossary. This is an important resource for Cree linguistics as well as those interested in understanding the Cree perspective of Treaty 6.

Book Description

"Dammed: The Politics of Loss and Survival in Anishinaabe Territory" explores Canada’s hydroelectric boom in the Lake of the Woods area. It complicates narratives of increasing affluence in postwar Canada, revealing that the inverse was true for Indigenous communities along the Winnipeg River. "Dammed" makes clear that hydroelectric generating stations were designed to serve settler populations. Governments and developers excluded the Anishinabeg from planning and operations and failed to consider how power production might influence the health and economy of their communities. By so doing, Canada and Ontario thwarted a future that aligned with the terms of treaty, a future in which both settlers and the Anishinabeg might thrive in shared territories. The same hydroelectric development that powered settler communities flooded manomin fields, washed away roads, and compromised fish populations. Anishinaabe families responded creatively to manage the government-sanctioned environmental change and survive the resulting economic loss. Luby reveals these responses to dam development, inviting readers to consider how resistance might be expressed by individuals and families, and across gendered and generational lines. Luby weaves text, testimony, and experience together, grounding this historical work in the territory of her paternal ancestors, lands she calls home. With evidence drawn from archival material, oral history, and environmental observation, "Dammed" invites readers to confront Canadian colonialism in the twentieth century.

Canada's Residential Schools: The History, Part 1, Origins to 1939


Book Description

Between 1867 and 2000, the Canadian government sent over 150,000 Aboriginal children to residential schools across the country. Government officials and missionaries agreed that in order to “civilize and Christianize” Aboriginal children, it was necessary to separate them from their parents and their home communities. For children, life in these schools was lonely and alien. Discipline was harsh, and daily life was highly regimented. Aboriginal languages and cultures were denigrated and suppressed. Education and technical training too often gave way to the drudgery of doing the chores necessary to make the schools self-sustaining. Child neglect was institutionalized, and the lack of supervision created situations where students were prey to sexual and physical abusers. Legal action by the schools’ former students led to the creation of the Truth and Reconciliation Commission of Canada in 2008. The product of over six years of research, the Commission’s final report outlines the history and legacy of the schools, and charts a pathway towards reconciliation. Canada’s Residential Schools: The History, Part 1, Origins to 1939 places Canada’s residential school system in the historical context of European campaigns to colonize and convert Indigenous people throughout the world. In post-Confederation Canada, the government adopted what amounted to a policy of cultural genocide: suppressing spiritual practices, disrupting traditional economies, and imposing new forms of government. Residential schooling quickly became a central element in this policy. The destructive intent of the schools was compounded by chronic underfunding and ongoing conflict between the federal government and the church missionary societies that had been given responsibility for their day-to-day operation. A failure of leadership and resources meant that the schools failed to control the tuberculosis crisis that gripped the schools for much of this period. Alarmed by high death rates, Aboriginal parents often refused to send their children to the schools, leading the government adopt ever more coercive attendance regulations. While parents became subject to ever more punitive regulations, the government did little to regulate discipline, diet, fire safety, or sanitation at the schools. By the period’s end the government was presiding over a nation-wide series of firetraps that had no clear educational goals and were economically dependent on the unpaid labour of underfed and often sickly children.
