Book Description

Small Powers at Sea presents an analysis of the marine policies of Denmark, Norway and Sweden from the First UN Conference on the Law of the Sea in 1958 until the conclusion of the Third UN Conference on the Law of the Sea in 1982. The main substantive chapters cover security aspects, continental shelf policies, fisheries, shipping and marine environment as well as deep seabed mining. The study is comparative and conducted from a political science perspective, discussing how to explain the rather divergent Scandinavian marine policies. A state-centric rational actor model can explain much of the variance, but other factors, including cognitive ones and the role of domestic politics, must be included to obtain a fuller understanding of Scandinavian policies over time and across issue areas.

African States and Contemporary International Law

The Third Conference on the Law of the Sea marked a watershed in the emergence of African diplomatic and legal activities within the international system. Analysis of those states' participation therefore not only provides a template for the study of bloc activity at this level; it also adds the comprehensive analysis of African participation at UNCLOS III and, finally, it should also reveal the means by which states can more effectively impact global political and legislative processes. This study evaluates the extent to which the Exclusive Economic Zone (EEZ) concept represents an attempt by African states to allot to international law the task of correcting inequities between nations, and the future implications of such linkage. It critically explores and analyzes the conceptual framework that initiated action by African states in UNCLOS III, and it examines their attempts to operationalize this framework by their substantive participation in the negotiations. Finally, the study explores the future implications of African activity in the international legal and political system. In this evaluative process the author suggests the need for greater insight in conceptualizing the role of African states as a bloc within the international system. Only in this manner can a better appreciation be had of the important role African states are playing as contributors in the formation of contemporary international law.

Maritime Disputes and International Law

The settlement of the maritime boundary disputes between China and Japan in the East China Sea, and between Greece and Turkey in the Aegean Sea, is politically deadlocked. While diplomatic settlement efforts have been ongoing for the past several decades, neither side in each case appears prepared to back down from its respective maritime and territorial claims. Several incidents at sea have occurred, prompting diplomatic protests, military standoffs, even exchange of fire. The existing status quo is inherently unstable and does not favour either side to the extent that it holds hostage the multiple benefits that could otherwise be generated from the exploitation of the seabed energy and mineral resources in the disputed waters, creating an urgent need for a meaningful discussion on finding a practical way forward. This monograph undertakes a comprehensive analysis of these disputes based on the rules and principles of international law, critically evaluating possible institutional designs of inter-State cooperation over seabed activities in disputed maritime areas and makes recommendations for the prospect of realising joint development regimes in the East China Sea and the Aegean to coordinate the exploration for and exploitation of resources without having resorted previously to boundary delimitation settlement.

With respect to the freedom of navigation of other States in this exclusive economic zone, this book confirms that it is closely related to, and at times serves as a prerequisite for, the exercise of their other freedoms and lawful uses of the sea therein, and that any impact on the freedom of navigation of other States in the exclusive economic zone may affect their other freedoms or associated rights.
