This book is the first definitive history of the Northern Ireland Labour Party (NILP), a unique political force which drew its support from Protestants and Catholics and became electorally viable despite deep-seated ethnic, religious and national divisions. Formed in 1924 and disbanded in 1987, the NILP succeeded in returning several of its members to the locally-based Northern Ireland parliament in 1925–29 and 1958–72 and polled some 100,000 votes in both the 1964 and the 1970 British general elections. As British Labour’s ‘sister’ party in the province from the late 1920s until the late 1970s, the NILP could rely on substantive fraternal and organisational support at critical junctures in its history. Despite its political successes the NILP’s significance has been downplayed by historians, partly because of the lack of empirical evidence and partly to reinforce the simplistic view of Northern Ireland as the site of the most protracted sectarian conflict in modern Europe. For the first time this book brings together important archival sources and the oral testimonies of former NILP members to explain the enigma of an extraordinary political party operating in extraordinary circumstances. The book situates the NILP’s successes and failures in a broad historical framework, providing the reader with a balanced account of twentieth-century Northern Irish political history. This book will appeal to students and scholars of labour movements, as well as non-specialists who wish to learn more about the NILP’s brand of democratic socialism, its ideological and logistical ties to British Labour and the character of its cross-sectarian membership.

Mega-regional agreements have recently stirred controversy, producing a clash between the founding principles of liberalisation and protectionism, giving rise to competence issues between the European Union and its Member States. Although scholarly work has focused for years on the controversial “social clause”, it is now worth carrying out a detailed, legal analysis of the labour standards contained in the mega-regional trade agreements adopted and negotiated by the EU and the US. The topic gives rise to much controversy, as it is influenced by political convictions and election results. For this reason, it poses one of the most significant challenges to international labour law. Based on these considerations, this book examines the social dimension of three of the most relevant mega-regional trade agreements, namely TTP, CETA, and TTIP. It is argued that trade liberalisation should be accompanied by progress in the social and labour field.

As the world economy is liberalized, and national economies become more intertwined, the national decision making of states is also increasingly interdependent, and it has become vital for non-governmental organizations to create an international agenda. This title is an important study of what makes such organizations successful on an international level. The focus is on trade unions, as a key international group of NGOs. It asks whether a global system can be designed to stimulate countries to observe a set of minimum or core standards. It explores three important questions: how have unions attempted to influence the debate on the inclusion of minumum labour standards in the WTO agreement?; what accounts for their success or lack of success?; and what conclusions, with respect to the effective behaviour of trade unions in the construction of international policy, can be drawn from these experiences? Transnational Labour Regulation

This book illuminates the process and substance of transnational regulation of labour in a global economy. Transnational labour regulation, a central feature of the European social model, engages the 27 Member States of the European Union, and is of potential importance to the rest of the world. The book analyses the attempts at transnational regulation of temporary agency work through the social dialogue between trade unions and employers' organisations at European level and the subsequent - and so far fruitless - EU legislative process. These two processes of transnational labour regulation, and their interaction, until now have been largely invisible. The book also highlights distinctive features of Member States' national regulation as they interacted with the debates on EU transnational labour regulation. It further explores the overlap between regulation of temporary agency work and the EU's regulation of transnational trade in services, the subject of the Directive on services in the internal market. Finally, it draws lessons from the experience of regulation of temporary agency work at national and European levels for transnational labour regulation in general.

By exploring different approaches to the study of labour law, this book re-evaluates how it is conceived, analysed, and criticized in current legislation and policy. In particular, it assesses whether so-called 'old ways' of thinking about the subject, such as the idea of the labour constitution, developed by Hugo Sinzheimer in the early years of the Weimar Republic, and the principle of collective laissez-faire, elaborated by Otto Kahn-Freund in the 1950s, are in fact outdated. It asks whether, and how, these ideas could be abstracted from the political, economic, and social contexts within which they were developed so that they might still usefully be applied to the study of labour law. Dukes argues that the labour constitution can provide an 'enduring idea of labour law', and an alternative to modern arguments which favour reorienting labour law to align more closely with the functioning of labour markets. Unlike the 'law of the labour market', the labour constitution highlights the inherently political nature of labour laws and institutions, as well as their economic functions. It constructs a framework for analysing labour laws, labour markets, and institutions, to allow scholars to critique the current policy climate and, in light of the ongoing expansion of the global labour market, assess the impact of the narrowing and disappearance of spaces for democratic deliberation and democratic decision-making on workers' rights.
