A Treatise on the Law of Public Contracts (Classic Reprint)

Book Description

Excerpt from A Treatise on the Law of Public Contracts The method by which I proceeded, wherever this was possible, was to state the general principle affecting the particular subject in hand, then to state the subsidiary principles or exceptions to the rule, and lastly to illuminate these, when possible, by appropriate illustrations. In the examination of thousands of cases I have selected these best illustrating the text and have not attempted to weigh down the footnotes by excessive citation. With very few exceptions every case cited is a public contract case. The work does not include the subject of governmental or municipal bonds. It will at once be seen that they are essentially different from those of the admirable works of Lord St. Leonards and Mr. Dart on the Law of Vendors and Purchasers. Those treatises dis cuss the contract of sale of real estate and all the relations thence arising. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. A Treatise on the Law of Extraordinary, Industrial and Interstate Contracts (Classic Reprint)

Book Description

Excerpt from A Treatise on the Law of Extraordinary, Industrial and Interstate Contracts Many works on contracts now before the public are classics, but they do not treat the subjects of contract of paramount importance to the welfare of the people. So, to meet this demand, among other things of vital interest, it has been the endeavor to present the industrial side of this all-important subject. In developing this work it was found that interstate contracts, of necessity, must be discussed; so it was deemed advisable to review concisely interstate contracts. The author has also cited the leading articles on like ques tions found in the legal magazines, to illustrate the views of jurists on controverted points. The author takes this opportunity to thank the profession, both lawyers and judges, for the cordial reception of his former works, and hopes that this treatise will be received in the same friendly spirit. A Treatise on the Law of Contracts, Vol. 1 of 2 (Classic Reprint)

Book Description

Excerpt from A Treatise on the Law of Contracts, Vol. 1 of 2 The present work is intended, primarily, as a text-book for students, but it is by no means restricted in its scope or design to such a use. Its purpose is not only to sketch an elementary outline of the law relating to simple contracts, but to elucidate and systematize, as far as practicable, the general law applicable to the subject; in the hope that it may serve alike the student and the practitioner. It is believed, that such a work is now needed by the profession, for new circumstances and exigencies so modify and expand every department of jurisprudence, as to require new expositions of the law, however valuable preceding treatises may have been. The plan of the present work has been to render cases sub ordinate to principles, and, instead of pursuing the common method of merely digesting the various authorities, to throw the main body Of them into the notes, and to incorporate those only in the text, which seemed to afford the best illustrations of the doctrine under consideration. A Treatise on the Law of Contracts, Vol. 1 (Classic Reprint)

Book Description

Excerpt from A Treatise on the Law of Contracts, Vol. 1 Here I would have gladly stopped but the necessities of the practicing lawyer and the precedent of previous editions seemed to call for a summary of the law of stamps; and this I have accordingly added in a separate book, which the student, who will find in it little to reward him, can avoid. Although I have endeavored, in the manner above stated, to throw the work, so far as its principal divisions are concerned, into a somewhat more systematic and logical form, i cannot flatter myself that I have carried out my design into all the details of the work. Such a task would have required far more leisure than I have been able to find in the short interval which has elapsed since the last edition, which is now exhausted, was published. Some little I have done, and morei hope to do, if I am permitted to revise another edition; but I must trust to the indulgence of the profession to excuse many defects of which I am painfully conscious. The reader will notice that the type has been enlarged, and that the Index is no longer printed in double columns, an alteration which will be found considerably to increase the facility of using it, as it admits of easier distinction of the subjects falling under each head by variations of the marginal spaces. The head-notes of the different chapters, which, being printed in double columns and without refer ence to the pages, were quite useless, have been omitted.
