Anthropology of Law in Muslim Sudan analyses the hybridity of law systems and the plurality of legal practices in rural and urban contexts of contemporary Sudan, shedding light on the complex relation between Islam and society. It is the outcome of the international research program ANDROMAQUE (Anthropologie du Droit dans les Mondes Musulmans Africains et Asiatiques), funded by the French ANR (Agence National de la Recherche) between 2011 and 2014. Crossing two disciplinary perspectives, anthropology and law, the present volume contains original fieldwork data on contemporary urban and rural Sudan. Focusing on two major domains, land property and courts, several case studies demonstrate the relevance of an approach based on “legal practices” to underline, first, the plurality and hybridity of law systems and the relative role of the Islamic reference in Sudanese society, and, secondly, the reshaping of legal behaviors and norms after the breaking point of South Sudan's independence in 2011. Animism of the Nilotics and Discourses of Islamic Fundamentalism in Sudan


Book Description

This book provides a comprehensive analysis of Animism as a religion and a culture of the Nilotic peoples of the Upper River Nile in modern "Southern Sudan". It gives an account of how the animistic ritual performances of the divine chief-priests are strategies in conflict management and resolution. For centuries, the Nilotic peoples have been resisting changes to new religious identities and conservatively remained Animists. Their current interactions with the external world, however, have transformed their religious identities. At present, the Nilotics are Animist-Christians or Animist-Muslims. This does not mean that the converted Nilotics relinquish Animism and become completely assimilated to the new religious prophetic dogmas, instead, they develop compatible religious practices of Animism, Christianity and Islam. New Islamic fundamentalism in Sudan which is sweeping Africa into Islamic religious orthodoxy, where Sharia (Islamic law) is the law of the land, rejects this compatibility and categorises the Nilotics as "heathens" and "apostates". Such characterisation engenders opposing religious categories, with one side urging Sharia and the other for what this study calls "gradable" culture. Kuel Jok is a researcher at the Department of World Cultures at the University of Helsinki. In Sudan, Jok obtained a degree in English Linguistics and Literature and diplomas in Philosophy and Translation. He also studied International Law in Egypt. In Europe, Jok acquired an MA in Sociology from the University of Joensuu, Finland and a PhD in the same field from the University of Helsinki, Finland.




Multidimensional Change in Sudan (1989–2011)

Based on fieldwork largely collected during the CPA interim period by Sudanese and European researchers, this volume sheds light on the dynamics of change and the relationship between microscale and macroscale processes which took place in Sudan between the 1980s and the independence of South Sudan in 2011. Contributors’ various disciplinary approaches—socio-anthropological, geographical, political, historical, linguistic—focus on the general issue of “access to resources.” The book analyzes major transformations which affected Sudan in the framework of globalization, including land and urban issues; water management; “new” actors and “new conflicts”; and language, identity, and ideology.

Ordinary Sudan, 1504–2019

This book starts from the premise that the study of "exceptionally normal" women and men – as conceived by microhistory – has radical implications for understanding history and politics, and applies this notion to Sudan. Against a historiography dominated by elite actors and international agents, it examines both how ordinary people have brought about the most important political shifts in the country’s history (including the recent revolution in 2019) and how they have played a role in maintaining authoritarian regimes. It also explores how men and women have led their daily lives through a web of ordinary worries, desires and passions. The book includes contributions by historians, anthropologists, and political scientists who often have a dual commitment to Middle Eastern and African studies. While focusing on the complexity and nuances of Sudanese local lives in both the past and the present, it also connects Sudan and South Sudan with broader regional, global, and imperial trends. The book is divided into two volumes and six parts, ordered thematically. The first part tackles the entanglement between archives, social history, and power. The second focuses on women’s agency in history and politics from the Funj era to the recent 2018-2019 revolution. Part 3 includes contributions on the history and global connections of the Sudanese armed forces. In the second volume, part 4 intersects the themes of urban life, leisure, and colonial attitudes with queerness. In part 5, labour identities, practices, and institutions are discussed both in urban milieus and against the background of war and expropriation in rural areas. Finally, part 6 studies the construction of social consent under various self-styled Islamic regimes, as well as the emergence of alternative imaginaries and acts of citizenship in times of political openness.




Constitution-making and Human Rights in the Sudans

Sudan and South Sudan have suffered from repeated cycles of conflict and authoritarianism resulting in serious human rights and humanitarian law violations. Several efforts, such as the 2005 Comprehensive Peace Agreement and transitional justice initiatives have recognized that the failure to develop a stable political and legal order is at the heart of Sudan’s governance problems. Following South Sudan’s independence in 2011, parallel constitutional review processes are under way that have prompted intense debates about core issues of Sudan’s identity, governance and rule of law, human rights protection and the relationship between religion and the State. This book provides an in-depth study of Sudan’s constitutional history and current debates with a view to identifying critical factors that would enable Sudan and South Sudan to overcome the apparent failure to agree on and implement a stable order conducive to sustainable peace and human rights protection. It examines relevant processes against the broader (constitutional) history of Sudan and identifies the building blocks for constitutional reforms through a detailed analysis of Sudanese law and politics. Documenting Displacement


Book Description

Legal precarity, mobility, and the criminalization of migrants complicate the study of forced migration and exile. Traditional methodologies can obscure both the agency of displaced people and hierarchies of power between researchers and research participants. This project critically assesses the ways in which knowledge is co-created and reproduced through narratives in spaces of displacement, advancing a creative, collective, and interdisciplinary approach. Documenting Displacement explores the ethics and methods of research in diverse forced migration contexts and proposes new ways of thinking about and documenting displacement. Each chapter delves into specific ethical and methodological challenges, with particular attention to unequal power relations in the co-creation of knowledge, questions about representation and ownership, and the adaptation of methodological approaches to contexts of mobility. Islamic Law and Society in the Sudan
