Property in Social Continuity


Book Description

This book deals with the property and inheritance system of the matrilineal Minangkabau of West Sumatra in the context of legal pluralism. The author proposes a new anthropological approach to law, property and inheritance. After the description of the Minangkabau socio-political organization and the development of legal and administrative pluralism, three chapters are devoted to property and inheritance proper. First the ideal legal systems are described. Then he illustrates how the Minangkabau actually handle their property and inheritance affairs, and how the various regulating mechanisms have changed through history. Finally the different agents creating and changing legal conceptions are treated in historical perspective. In his conclusions the author shows how the traditional system of common holding and distributing of property by matrilineal descent groups is slowly being undermined through an increasing monetarization and consequent individualization of property relationships which finds its expression in the form of new legislation. This development is reflected in the conceptual system where the formerly predominant diachronic dimension of property relationships is slowly abolished and where property rights are increasingly reified.

This book covers the relationship between societies and their culture in the context of traditional settlement in Indonesia. The focus of the study is on the search for meanings of local concepts. This study reveals and analyzes the concepts concerning home and their sociocultural strategies for maintaining a sense of community and identity. In this study, identifying local concepts becomes the hallmark and the hub of analyses that explore, verify and establish relations between ideas and phenomena. Based on these relations, this study attempts to capture the reality of the local world that upholds and sustains the communities’ values, norms and principles for what they may call a homeland. The book is organized into two parts. Part I describes a cross-regional habitation in Indonesia, while Part II presents four ethnic regions of Indonesia - Sa’dan Toraja, Bali, Naga and Minangkabau. Their unique traditions, customs, beliefs and attitudes serve to provide diversity in terms of their backgrounds and lifestyles, though they share the challenge of sustaining their sense of home in the face of modernity as characterized by changes and developments toward a technologically industrialized society. This volume examines dynamics of legal pluralism and explores the varied ways in which constellations of legal pluralism play out in social life. It aims to bridge the social and theoretical space between small scale case studies and abstract generalization. The introduction provides an overview of developments in the field of legal pluralism and offers an analytical perspective on the dynamics of the maintenance of and change in constellations of legal pluralism. Contributions examine situations in which the state is seen as remote from local settings and others in which local populations are actively engaged in widening the scope and validity of state law. Muslims and Matriarchs is a history of an unusual, probably heretical, and ultimately resilient cultural system. The Minangkabau culture of West Sumatra, Indonesia, is well known as the world's largest matrilineal culture; Minangkabau people are also Muslim and famous for their piety. In this book, Jeffrey Hadler examines the changing ideas of home and family in Minangkabau from the late eighteenth century to the 1930s. Minangkabau has experienced a sustained and sometimes violent debate between Muslim reformists and preservers of indigenous culture. During a protracted and bloody civil war of the early nineteenth century, neo-Wahhabi reformists sought to replace the matriarchate with a society modeled on that of the Prophet Muhammad. In capitulating, the reformists formulated an uneasy truce that sought to find a balance between Islamic law and local custom. With the incorporation of highland West Sumatra into the Dutch empire in the aftermath of this war, the colonial state entered an ongoing conversation. These existing tensions between colonial ideas of progress, Islamic reformism, and local custom ultimately strengthened the matriarchate. The ferment generated by the trinity of oppositions created social conditions that account for the disproportionately large number of Minangkabau leaders in Indonesian politics across the twentieth century. The endurance of the matriarchate is testimony to the fortitude of local tradition, the unexpected flexibility of reformist Islam, and the ultimate weakness of colonialism. Muslims and Matriarchs is particularly timely in that it describes a society that experienced a neo-Wahhabi jihad and an extended period of Western occupation but remained intellectually and theologically flexible and diverse.




A Genealogy of Islamic Feminism


Book Description

A Genealogy of Islamic Feminism offers a new insight on the changing relationship between Islam and feminism from the colonial era in the 1900s to the early 1990s in Indonesia. The book juxtaposes both colonial and postcolonial sites to show the changes and the patterns of the encounters between Islam and feminism within the global and local nexus. Global forces include Dutch colonialism, developmentalism, transnational feminism, and the United Nations’ institutional bodies and their conferences. Local factors are comprised of women’s movements, adat (customs), nationalism, the politics underlying the imposition of Pancasila ideology and maternal virtues, and variations of Islamic revivalism. Using a genealogical approach, the book examines the multifaceted encounters between Islam and feminism and attempts to rediscover egalitarianism in the Islamic tradition—a concept which has been subjugated by hierarchical gender systems. The book also systematizes Muslim women’s encounters with Islam and feminism into five phases: emancipation, association, development, integration, and proliferation eras. Each era discusses the confluence of global and local factors which shape the changing relationship between Islam and feminism and the way in which the discursive narrative of equality is debated and contextualized, progressing from biological determinism (kodrat) to the ethico-spiritual argument. Islamic feminism contributes to the rediscovery of Islam as the source of progress, the centering of women’s agency through spiritual equality, and the reworking of the private and public spheres.
