Child Soldiers as Agents of War and Peace


Book Description

This book deals with child soldiers’ involvement in crimes under international law. Child soldiers are often victims of grave human rights abuses, and yet, in some cases, they also participate actively in inflicting violence upon others. Nonetheless, the international discourse on child soldiers often tends to ignore the latter dimension of children’s involvement in armed conflict and instead focuses exclusively on their role as victims. While it might seem as though the discourse is therefore beneficial for child soldiers as it protects them from blame and responsibility, it is important to realize that the so-called passive victim narrative entails various adverse consequences, which can hinder the successful reintegration of child soldiers into their families, communities and societies. This book aims to address this dilemma. First, the available options for dealing with child soldiers’ participation in crimes under international law, such as transitional justice and criminal justice, and their shortcomings are analyzed in depth. Subsequently a new approach is developed towards achieving accountability in a child-adequate way, which is called restorative transitional justice. This book is in the first place aimed at researchers with an interest in child soldiers, children and armed conflict, as well as international criminal law, transitional justice, juvenile justice, restorative justice, children’s rights, and international human rights law. Secondly, professionals working on issues of transitional justice, juvenile justice, international criminal law, children’s rights, and the reintegration of child soldiers will also find the subject matter of great relevance to their practice. Based on ethnographic fieldwork and interviews from across Colombia—including former child guerillas, former hostages of the guerilla organization, mothers of child soldiers, and humanitarian aid workers— this volume explores the experiences of children involved with the Colombian guerilla group the Fuerzas Armadas Revolucionarias de Colombia (Farc). Going beyond the predominant humanitarian perspectives on child soldiers, Johanna Higgs delves into the specific social and cultural aspects of the Colombian conflict to give a contextualized, culturally relevant understanding of the processes of both militarization and demobilization of children, deploying the theoretical lens of “lifeworlds.” In so doing, Higgs not only provides insight into children’s involvement in conflict in Colombia, but presents a clear case for a move away from homogenized understandings of “child soldiers,” thus far dominated by viewpoints from industrialized Western nations. Social Justice for Children in the South


Book Description

This book considers that contextual factors are important for the achievement of social justice and it recognizes that vulnerability to which children are exposed is a phenomenon throughout the planet, particularly in the South. It presents a theoretical review of social justice as well as different situations of vulnerability children experience in their daily lives in which they can be injured, affecting their well-being and the exercise of their rights. It examines the impact of the COVID-19 pandemic on children, considered as a vulnerable group warranting special social policy considerations. It also presents the need to change power structures in knowledge production and decision-making processes to achieve social justice for children; the importance of investing in children; the exclusion of children from participation in certain activities and the shame of not being able to participate in equal conditions with others; the lives of migrant children belonging to ethnic minorities exposed to language barriers and access to technological devices; and the analysis of the process of social re-integration of children from conditions of armed conflict. The book concludes that governments need to assume social justice as part of universal human interests, providing security, conditions for well-being, and guaranteeing social justice for all children.
