King, 86 Va. 97, 9 S. E. 506; Adams v.Hays. 86 Va. 153, 9 S. E. 1019; South West Imp. Co. v. Andrew, 86 Va. 270. 9 S. E. 1015; Wood's Case, 86 Va. 929, 11 S. E. 798; South West Imp. Co. v. Smith's Adm'r, 85 Va. 306, 7 S. E. 3%, 17 Am. St. Rep. 59; Bernard v. Railroad, 85 Va. 792, 8 S. E. 785, 17 Am. St. Rep. 103. And this is so in criminal cases. Gordon's Case, 100 Va. 825, 41 S.
