Personality and Data Protection Rights on the Internet

Book Description

This book focuses on protection needs and new aspects of personality and data protection rights on the Internet, presenting a comprehensive review that discusses and compares international, European and national (Brazilian, German, Pakistani) perspectives. It deals with overarching questions, such as whether universal minimum standards of privacy protection can be developed or how regional data protection rights can be safeguarded and enforced extraterritorially, given the conditions of the Internet. Furthermore, the book addresses new challenges and novel rights, e. g., data retention and protection against mass surveillance, the right to be forgotten, rights to anonymity, legal issues of the digital estate or rights relating to algorithmic decision-making. Furthermore, the book explores how well-known paradigms, such as liability for personality rights violations or damages, have to be adapted in view of the significant role of intermediaries.

Philosophers in the Technological Age

Book Description

Greek philosophers built great discussions about reality, which are still current in our times and still inspire today's great thinkers. From mathematical teachings by Pythagoras, encompassing Plato's and Aristotle's ideas, these great discussions have been essential for our present intelectual development. Today, however, this role has been adopted by a new class of visionaries. Brought together by this new Platonic Academy based in Stanford University; devoted to proving and making use of the supremacy of numbers and mathematics in the digital world; intent on finding the new Holy Grail embodied in the perfect algorithm, present time's entrepreneurs of new technologies have radically transformed, for good or otherwise, the world as we know it. Ulrich Richter Morales delves deep into the legacy – sometimes clear, sometimes mystical and esoteric – of the Pythagoreans in their diverse historical incarnations. He particularly emphasizes their dominant role in these digital times, while he introduces a debate regarding the sort of machines we ought to develop. Elon Musk, Steve Jobs, Bill Gates, Jeff Bezos, Larry Page and Sergey Brin, among others, are declared heirs of the Mathematician from Samos and, always engrossed in polemic discussions, they are inseparable from our concept of how the world works. Getting to know them as persons and as thinkers is a way to better understand modern day life and our role as citizens, in the unstable, volatile grounds we tread on today.

Cross-Border Infringement of Personality Rights via the Internet

Book Description

Conflicts of laws arising from injuries to rights of personality—such as defamation or invasion of privacy—have always been difficult, if only because they implicate conflicting societal values about the rights of freedom of speech and access to information, on the one hand, and protection of reputation and privacy, on the other hand. The ubiquity of the internet has dramatically increased the frequency and intensity of these conflicts. This book explores the ways in which various Western countries have addressed these conflicts, but also advances new, practical ideas about how these conflicts should be resolved. These ideas are part of an international model law unanimously adopted by a Resolution of the Institut de droit international, which addresses jurisdiction, choice of law, and recognition and enforcement of foreign judgments. The book provides extensive article-by-article commentary, which explains the philosophy and intended operation of the Resolution.

Constitutional Questions in Latin America and Peru

Book Description

The book delves into constitutional essays focused on Latin America, with a particular emphasis on Peru. It explores legal theories surrounding the development of human rights, rooted in constitutional pluralism. Drawing from the insights gathered by organizations within the Inter-American Human Rights System, notably the Court and the Commission, this examination extends to its impact on local judicial bodies, including the Judiciary and notably the Constitutional Court. These efforts aim to protect traditional civil and political rights alongside social rights. However, the work also addresses the ongoing challenge of safeguarding emerging rights, such as fundamental digital and environmental rights, while bolstering protections for vulnerable populations like migrants and the LGBTQ+ community. By adopting a holistic approach, the book aspires to serve as a valuable resource for academics, experts, students, and professionals engaged in the study and practice of Latin American Constitutionalism.
