Italian Populism and Constitutional Law


Book Description

This edited volume explores the relationship between constitutionalism and populism in the Italian context. Italian populism is of interest to comparative lawyers for many reasons. Firstly, the country has a long-lasting tradition of anti-parliamentarism over the course of its history as a unitary state. After the 2018 general election, it has turned into the first European country in which two self-styled populist parties formed a coalition government. Although it collapsed in August 2019, many issues that it had raised remain. Secondly, as Italy is a founding member of the European Communities, the constitutional implications of populist politics have to be considered not only within the national framework but also in a wider context. This book argues that the relationship between populism and constitutionalism should not be seen in terms of mutual exclusion and perfect opposition. Indeed, populism frequently relies on concepts and categories belonging to the language of constitutionalism (majority, democracy, people), offering a kind of constitutional counter-narrative.

Work is constantly reshaped by technological progress. New ways of production are adopted, markets expand, and societies evolve. But some changes provoke more attention than others, in part due to the vast uncertainty involved in making predictions about the future. The 2019 World Development Report will study how the nature of work is changing as a result of advances in technology today. Technological progress disrupts existing systems. A new social contract is needed to smooth the transition and guard against rising inequality. Significant investments in human capital throughout a person’s lifecycle are vital to this effort. If workers are to stay competitive against machines they need to train or retool existing skills. A social protection system that includes a minimum basic level of protection for workers and citizens can complement new forms of employment. Improved private sector policies to encourage startup activity and competition can help countries compete in the digital age. Governments also need to ensure that firms pay their fair share of taxes, in part to fund this new social contract. The 2019 World Development Report presents an analysis of these issues based upon the available evidence.

Da qualche anno, l'innovazione tecnologica ha sconvolto il sistema delle telecomunicazioni. Le tre piattaforme tradizionali (telefono, televisione, internet) si sovrappongono nell'area della "convergenza". Il diritto delle telecomunicazioni, tradizionalmente regolato dal diritto pubblico, oggi è regolato da norme privatistiche. Con gli interventi della Corte costituzionale e sulla spinta del diritto comunitario, dal monopolio di Stato nelle Poste, nella Televisione, nella Telefonia si è passati, con le privatizzazioni e la liberalizzazione dei servizi, a un sistema concorrenziale. In questo quadro, il diritto d'autore sta vivendo la sua crisi. Un settore del diritto, tradizionalmente associato alle più elevate ed elitarie espressioni dell'ingegno umano, alla musica, alla pittura, alla scultura e alle opere letterarie si trova, improvvisamente, proiettato nel mondo della tecnologia più avanzata e sofisticata. E da scudo di autori, compositori, musicisti ed artisti squattrinati, è divenuto "arma di distruzione di massa". Secondo alcuni, siamo tutti pirati. E occorre sorvegliare la rete, per giungere a controllare l'intera area della "convergenza". Non esistono più, nel nuovo diritto d'autore, "utilizzazioni libere", ma solo "eccezioni e limitazioni". Questo studio vuole essere una difesa della "copia privata" e della liceità della "riproduzione per fruizione" di ogni opera. L'opera conclude che non siamo tutti pirati e che occorre trovare il modo di distinguere tra le organizzazioni criminali dell'industria del falso e cittadini della Repubblica: i primi vanno combattuti, i cittadini lasciati stare.
