Enduring Territorial Disputes

Of all the issues in international relations, disputes over territory are the most salient and most likely to lead to armed conflict. Understanding their endurance is of paramount importance. Although many states have settled their disagreements over territory, seventy-one disputes involving nearly 40 percent of all sovereign states remain unresolved. In this study, Krista E. Wiegand examines why some states are willing and able to settle territorial disputes while others are not. She argues that states may purposely maintain disputes over territory in order to use them as bargaining leverage in negotiations over other important unresolved issues. This dual strategy of issue linkage and coercive diplomacy allows the chal­lenger state to benefit from its territorial claim. Under such conditions, it has strong incentive to pursue diplomatic and militarized threats and very little incentive to settle the dispute over territory. Wiegand tests her theory in four case studies, three representing the major types of territorial disputes: uninhabited islands and territorial waters, as seen in tensions between China and Japan over the Senkaku and Diaoyu Islands; inhabited tracts of territory, such as the North African enclaves of Ceuta and Melilla affecting Morocco and Spain; and border areas, like the Shebaa Farms dispute between Lebanon and Israel. A fourth case study of a dispute between China and Russia represents a combination of all three types; settled in 2008, it serves as a negative example. All these disputes involve areas that have key strategic and economic importance both region­ally and globally.

China's Maritime Disputes in the East and South China Seas

Today's hearing will cover China's maritime disputes in the East and South China Seas. We'll examine the security, political, legal, and economic drivers of these disputes in our three panels today. The first panel will begin by discussing the broad security situation on the high seas. As China's maritime forces have become more capable over the past decade, Beijing has become more confident in its ability to assert its claims in the disputed areas. Beyond China's "hard" security concerns, however, other domestic, political, and legal elements shape China's policy in the East and South China Seas. Our second panel will consider popular nationalism as one of these elements. It has become a key driver of Chinese foreign policy as personality politics in Beijing has given way to a collective leadership seeking Party legitimacy. We'll conclude with a panel on how resources and economic drivers shape China's maritime disputes. Security of China's near seas is critical to the unimpeded flow of trade and imported energy resources. Though the natural resources in the East and South China Sea undoubtedly shape the security landscape, there appears to be a debate on the centrality of oil and gas resources to the dispute.




Multilateral Constraints on Chinese Behavior in South China Sea Territorial Disputes

Why have the bargaining strategies of the interested states in South China Sea (SCS) territorial disputes changed over time? To date, scholarship has analyzed states' overall strategies towards the SCS, domestic determinants of bargaining strategies, and China's remarkable growth and unique position in the world system. But what about international constraints on crisis bargaining? This paper will argue that China's willingness to engage in restrained negotiating behavior during the bargaining process is constrained by the degree to which it is accountable to the international institutional status quo and the financial system that supports it. China's decision to exercise restraint in bargaining passes through two analytical dimensions: an assessment of its power relative to neighbors and an analysis of the costs and benefits of defying multilateral institutions. My theory predicts unrestrained, more aggressive bargaining when relative power is high and the state in question is decreasingly accountable to international multilateral institutions. Using case studies and historical sources, this paper finds that restraint in bargaining behavior in the South China Sea from the 1970s to the present is directly related to relative power and the extent to which China's behavior is constrained by its accountability to international multilateral institutions. These findings are applicable to academics and policymakers considering the engagement between countries and the world order.
