Book Description

Electronic Documents and Signatures (US Federal Motor Carrier Safety Administration Regulation) (FMCSA) (2018 Edition) The Law Library presents the complete text of the Electronic Documents and Signatures (US Federal Motor Carrier Safety Administration Regulation) (FMCSA) (2018 Edition). Updated as of May 29, 2018 FMCSA amends its regulations to allow the use of electronic records and signatures to satisfy FMCSA's regulatory requirements. These amendments permit the use of electronic methods to generate, certify, sign, maintain, or exchange records so long as the documents accurately reflect the required information and can be used for their intended purpose. This rule applies only to those documents that FMCSA's regulations obligate entities or individuals to retain; it does not apply to forms or other documents that must be submitted directly to FMCSA unless there are already procedures in place in the regulations for electronic submission to FMCSA. This rule partially implements the Government Paperwork Elimination Act (GPEA) and the Electronic Signatures in Global and National Commerce Act (E-SIGN). Electronic On-Board Recorders and Hours of Service Supporting Documents (Us Federal Motor Carrier Safety Administration Regulation) (Fmcsa) (2018 Edition)

Book Description

Electronic On-Board Recorders and Hours of Service Supporting Documents (US Federal Motor Carrier Safety Administration Regulation) (FMCSA) (2018 Edition) The Law Library presents the complete text of the Electronic On-Board Recorders and Hours of Service Supporting Documents (US Federal Motor Carrier Safety Administration Regulation) (FMCSA) (2018 Edition). Updated as of May 29, 2018 The Federal Motor Carrier Safety Administration (FMCSA) proposes to amend the Federal Motor Carrier Safety Regulations (FMCSRs) to require certain motor carriers operating commercial motor vehicles (CMVs) in interstate commerce to use electronic on-board recorders (EOBRs) to document their drivers' hours of service (HOS). Under this proposal, all motor carriers currently required to maintain Records of Duty Status (RODS) for HOS recordkeeping would be required to use EOBRs to systematically and effectively monitor their drivers' compliance with HOS requirements. Additionally, this proposal sets forth the supporting documents that all motor carriers currently required to use RODS would still be required to obtain and keep, as required by section 113(a) of the Hazardous Materials Transportation Authorization Act (HMTAA). It explains, however, that although motor carriers subject to the proposed EOBR requirements would still need to retain some supporting documents, they would be relieved of the requirements to retain supporting documents to verify driving time. FMCSA also proposes to require all motor carriers-both RODS and timecard users-to systematically monitor their drivers' compliance with HOS requirements. Motor carriers would be given 3 years after the effective date of the final rule to comply with these requirements. Book Description

Unified Registration System (US Federal Motor Carrier Safety Administration Regulation) (FMCSA) (2018 Edition) The Law Library presents the complete text of the Unified Registration System (US Federal Motor Carrier Safety Administration Regulation) (FMCSA) (2018 Edition). Updated as of May 29, 2018 The FMCSA amends its regulations to require interstate motor carriers, freight forwarders, brokers, intermodal equipment providers (IEPs), hazardous materials safety permit (HMSP) applicants, and cargo tank facilities under FMCSA jurisdiction to submit required registration and biennial update information to the Agency via a new electronic on-line Unified Registration System (URS). Updated as of May 29, 2018 FMCSA amends the Federal Motor Carrier Safety Regulations (FMCSRs) to require certified medical examiners (MEs) performing physical examinations of commercial motor vehicle (CMV) drivers to use a newly developed Medical Examination Report (MER) Form, MCSA-5875, in place of the current MER Form and to use Form MCSA-5876 for the Medical Examiner's Certificate (MEC); and report results of all CMV drivers' physical examinations performed (including the results of examinations where the driver was found not to be qualified) to FMCSA by midnight (local time) of the next calendar day following the examination. The reporting of results includes all CMV drivers who are required to be medically certified to operate in interstate commerce, not only those who hold or apply for commercial learner's permits (CLP) or commercial driver's licenses (CDL), and results of any examinations performed in accordance with the FMCSRs with any applicable State variances (which will be valid for intrastate operations only). For holders of CLP/CDLs (interstate and intrastate), FMCSA will electronically transmit driver identification, examination results, and restriction information from examinations performed from the National Registry to the State Driver's Licensing Agencies (SDLAs). The Agency will also transmit medical variance information for all CMV drivers electronically to the SDLAs. Limiting the Use of Wireless Communication Devices (Us Federal Motor Carrier Safety Administration Regulation) (Fmcsa) (2018 Edition)

Book Description

Limiting the Use of Wireless Communication Devices (US Federal Motor Carrier Safety Administration Regulation) (FMCSA) (2018 Edition) The Law Library presents the complete text of the Limiting the Use of Wireless Communication Devices (US Federal Motor Carrier Safety Administration Regulation) (FMCSA) (2018 Edition). Updated as of May 29, 2018 The Federal Motor Carrier Safety Administration (FMCSA) proposes to prohibit texting by commercial motor vehicle (CMV) drivers while operating in interstate commerce and to impose sanctions, including civil penalties and disqualification from operating CMVs in interstate commerce, for drivers who fail to comply with this rule. Additionally, motor carriers would be prohibited from requiring or allowing their drivers to engage in texting while driving. FMCSA also proposes amendments to its commercial driver's license (CDL) regulations to add to the list of disqualifying offenses a conviction under State or local laws, regulations, or ordinances that prohibit texting by CDL drivers while operating a CMV, including school bus drivers. Recent research commissioned by FMCSA shows that the odds ratio of being involved in a safety-critical event (e.g., crash, near-crash, lane departure) is 23.2 times greater for drivers who engage in texting while driving than for those who do not. This rulemaking would increase safety on the Nation's highways by reducing the prevalence of or preventing certain truck- and bus-related crashes, fatalities, and injuries associated with distracted driving.
