Law and Sexual Misconduct in New England, 1650-1750

Having arriving in the Province of Maine in 1641 with a brief to create both government and law for the fledgling colony, Thomas Gorges later recorded his policy as having ’steared as neere as we could to the course of Ingland’. Over the course of the next century the various colonial administrations all consciously measured their laws against that of England, whether their intention was imitation of or conscious opposition to, established English legal system. In order to trace the shifting and contested relationships between colonial laws and English laws, this book focuses on the prosecution of sexual misconduct. All crimes can threaten orderly society but no other crime posed quite the same long term implications as illicit sex resulting in the birth of illegitimate children who became their own social challenges. Sexual misconduct was, consequently, a major concern for early modern leaders, making it a particularly fruitful subject for studying the complex relationship between laws in England and laws in the English colonies. Political and ecclesiastical leaders create laws to coerce people to behave in a certain fashion and to convey wider messages about the societies they govern. When those same laws are broken, lawbreakers must be tried and punished by a means intended to serve as a warning to other would-be lawbreakers. In this book the two-part analysis of changing sexual misconduct laws and the resulting trial depositions highlights the ways in which ordinary New England colonists across New England both interacted with and responded to the growing Anglicization of their legal systems and makes the argument that these men and women saw themselves as taking part in a much larger process.

Puritans Behaving Badly


Book Description

Tracing the first three generations in Puritan New England, this book explores changes in language, gender expectations, and religious identities for men and women. The book argues that laypeople shaped gender conventions by challenging the ideas of ministers and rectifying more traditional ideas of masculinity and femininity. Although Puritan's emphasis on spiritual equality had the opportunity to radically alter gender roles, in daily practice laymen censured men and women differently – punishing men for public behavior that threatened the peace of their communities, and women for private sins that allegedly revealed their spiritual corruption. In order to retain their public masculine identity, men altered the original mission of Puritanism, infusing gender into the construction of religious ideas about public service, the creation of the individual, and the gendering of separate spheres. With these practices, Puritans transformed their 'errand into the wilderness' and the normative Puritan became female.




Governing Masculinities in the Early Modern Period

Documenting lived experiences of men in charge of others, this collection creates a social and cultural history of early modern governing masculinities. It examines the tensions between normative discourses and lived experiences and their manifestations in a range of different sources; and explores the insecurities, anxieties and instability of masculine governance and the ways in which these were expressed (or controlled) in emotional states, language or performance. Focussing on moments of exercising power, the collection seeks to understand the methods, strategies, discourses or resources that men were able (or not) to employ in order to have this power. In order to elucidate the mechanisms of male governance the essays explore the following questions: how was male governance demonstrated and enacted through men's (and women's) bodies? What roles did women play in sustaining, supporting or undermining governing masculinities? And what are the relationship of specific spaces such as household or urban environments to notions and practice of governance? Finally, the collection emphasises the power of sources to articulate the ideas of governance held by particular social groups and to obscure those of others. Through a rich and wide range of case studies, the collection explores what distinctions can be seen in ideas of authoritative masculine behaviour across Protestant and Catholic cultures, British and Continental models, from the late medieval to the end of the eighteenth century, and between urban and national expressions of authority.

For the Puritan separatists of seventeenth-century New England, "godliness," as manifested by the body, was the sign of election, and the body, with its material demands and metaphorical significance, became the axis upon which all colonial activity and religious meaning turned. Drawing on literature, documents, and critical studies of embodiment as practiced in the New England colonies, Martha L. Finch launches a fascinating investigation into the scientific, theological, and cultural conceptions of corporeality at a pivotal moment in Anglo-Protestant history. Not only were settlers forced to interact bodily with native populations and other "new world" communities, they also fought starvation and illness; were whipped, branded, hanged, and murdered; sang, prayed, and preached; engaged in sexual relations; and were baptized according to their faith. All these activities shaped the colonists' understanding of their existence and the godly principles of their young society. Finch focuses specifically on Plymouth Colony and those who endeavored to make visible what they believed to be God's divine will. Quakers, Indians, and others challenged these beliefs, and the constant struggle to survive, build cohesive communities, and regulate behavior forced further adjustments. Merging theological, medical, and other positions on corporeality with testimonies on colonial life, Finch brilliantly complicates our encounter with early Puritan New England.




Press and Speech Under Assault

The early Supreme Court justices wrestled with how much press and speech is protected by freedoms of press and speech, before and under the First Amendment, and with whether the Sedition Act of 1798 violated those freedoms. This book discusses the twelve Supreme Court justices before John Marshall, their views of liberties of press and speech, and the Sedition Act prosecutions over which some of them presided. The book begins with the views of the pre-Marshall justices about freedoms of press and speech, before the struggle over the Sedition Act. It finds that their understanding was strikingly more expansive than the narrow definition of Sir William Blackstone, which is usually assumed to have dominated the period. Not one justice of the Supreme Court adopted that narrow definition before 1798, and all expressed strong commitments to those freedoms. The book then discusses the views of the early Supreme Court justices about freedoms of press and speech during the national controversy over the Sedition Act of 1798 and its constitutionality. It finds that, though several of the justices presided over Sedition Act trials, the early justices divided almost evenly over that issue with an unrecognized half opposing its constitutionality, rather than unanimously supporting the Act as is generally assumed. The book similarly reassesses the Federalist party itself, and finds that an unrecognized minority also challenged the constitutionality of the Sedition Act and the narrow Blackstone approach during 1798-1801, and that an unrecognized minority of the other states did as well in considering the Virginia and Kentucky Resolutions. The book summarizes the recognized fourteen prosecutions of newspaper editors and other opposition members under the Sedition Act of 1798. It sheds new light on the recognized cases by identifying and confirming twenty-two additional Sedition Act prosecutions. At each of these steps, this book challenges conventional views in existing histories of the early republic and of the early Supreme Court justices.
