Harnessing the Tax Code to Promote College Affordability

The United States tax code is full of provisions designed to encourage or reward specific behaviors, such as owning a home or saving for retirement. Tax benefits for higher education are no exception: Contributions to some college savings accounts grow tax-free, college tuition is often tax deductible, and some student-loan borrowers are able to deduct the interest paid on their student loans just as they would the interest paid on their mortgage. These higher education tax provisions have implications for access, affordability, and equity. Higher-income families benefit from tax-free savings toward future college costs through Section 529 college savings plans. The tax code, however, rewards middle-class families for savings less, because tax benefits are much smaller for those in lower tax brackets, and these families largely do not participate. This brief presents a menu of potential ideas for making each stage--before enrollment, during enrollment, and post-enrollment--more effective and equitable in terms of directing tax incentives to those who would benefit most from them.

Placing the recent rush to use tax incentives as a new source of student financial assistance in both its historical and theoretical contexts, this book documents the rise of tax-advantaged college savings plans and how they signal the shift to solving the challenge of middle-class affordability and its replacement of the twin goals of access and equity as public policy's greatest higher education funding priority. Including an in-depth analysis of the affordability crisis, a detailed encapsulation of the public-versus-private responsibility to pay for higher education debate and its historic roots, and the theoretical studies of student aid and the tax code, the book develops concrete definitions of the various types of tax-advantaged college savings plans, their origin and development and a detailed taxonomy of all such state-sponsored programs in the United States. Unique to this book, the taxonomy is based upon detailed State Profiles of all tax-advantaged college savings plans in existence circa 1999. Building upon the State Profiles and their taxonomic summary, the book analyzes the rhetoric of the documents surrounding each state's program's adoption in order to understand what the state's say such programs mean. Further, each program's characteristics are evaluated against a Continuum of "Publicness" in order to ascertain the state's position regarding the public-versus-private responsibility debate. The results is both a rhetorical and behavioral data set documenting the states' policy position elevating solving the challenge of middle-class affordability above the issues of access and equity. Although the concept of "publicness" is discovered to be highly ambiguous, thebook concludes with a Best Practices description of an ideal tax-advantaged college savings plan that maximizes public responsibility to pay for higher education. Such a program will be of great interest to all policy analysts and public officials concerned about maintaining the historic American commitment to access and equity.




Incentivizing Parental Support for College Tuition Through the Tax Code

University tuition costs continue to increase, while education continues to be important. Efforts to alleviate this problem must be undertaken carefully as to not simply aggravate the problem. To this end, this Article proposes that parental contribution towards university tuition be treated more favorably by the tax code, and in particular, be treated as tax deductible. Universities already expect parental contributions as part of a child's financial aid package, and this proposed tax deduction may help fulfill that expectation. Furthermore, this proposed deduction would spare students some reliance on the loan system, including the risk of default. This proposed deduction, finally, may be structured in a cost-neutral way. Specifically, the funds used for this deduction would be the taxpayer funds saved from the decrease in loan defaults and loan interest subsidies, which currently cost tens of billions of tax dollars.
