Actualmente, una de las principales preocupaciones para los legisladores se centra en la configuración de un régimen jurídico que aborde la responsabilidad civil por los daños causados por los robots autónomos con inteligencia artificial; robots que están pensados para interactuar cada vez más con los humanos; circunstancia que aumenta las posibilidades de daño hacia éstos, y que se encuentran capacitados para actuar sobre el ambiente que los rodea prescindiendo de las instrucciones de su propietario o programador. La pérdida de dirección que afecta al creador, propietario o programador del sistema inteligente, plantea el problema de dilucidar a quien debe imputársele la responsabilidad por el daño causado por el robot dentro de su margen de autonomía decisoria. En la obra se analizan las carencias y obstáculos que presenta nuestro actual sistema de responsabilidad civil para hacer frente a este nuevo tipo de daño fruto de la imparable y necesaria evolución tecnológica, al tiempo que se articulan nuevos regímenes de responsabilidad a partir de los supuestos que principalmente pueden plantearse en la práctica, ya que los cambios que estos sistemas inteligentes van a comportar en muchos sectores de la sociedad; entre ellos, en el sector de la responsabilidad civil por los daños que cometan a los humanos, no están cubiertos por los regímenes jurídicos actuales. As computational power, the volume of available data, IT systems’ autonomy, and the human-like capabilities of machines increase, robots and AI systems have substantial and growing implications for the law and raise a host of challenges to current legal doctrines.
