European governance ranks high on the present research agenda on Europe and has attracted considerable attention in public debate in the course of the past decade. This book takes a special approach as it highlights the multi-faceted interconnectedness of EU and national governance that comes with public policy making in the European space. The volume is a well chosen selection from the research of leading European scholars. These scholars provide an insight into the current debate on European governance by using state-of-the art, theory-orientated empirical research. The individual chapters give evidence of the functioning and the deficiencies of the penetrated system of governance that has emerged within the European Union. The spreading of competence across different levels and multiple arenas has created a dense and complex network of trans-national negotiations, shifting attention and resources from the national to the European space. European governance puts national governments under considerable pressure to live up to the competing demands of efficient performance and democratic accountability. Though member-states all face the same challenge, they have responded with different kinds of strategies. EU involvement has contributed to the restructuring of the relationship between the legislative and the executive and touches upon the equilibrium between the political and the economic sphere. It influences the interactions between political actors on the one hand and societal actors and the public on the other. The contributions highlight the diverse mechanisms which link EU and national governance and demonstrate the constraints but also the readiness and capacity of political bodies to adapt to demands from their environment. While the volume documents the sensitivity and vulnerability which is associated with interdependent governance, it also gives evidence of learning processes and successful adjustment which is achieved by developing a differentiated and flexible intitutional setting and which allows for further integration. Apart from this more functional view, individual chapters look at the penetrated system of European governance from a normative perspective and investigate the prospect of improving parliamentary accountability and the formation of a European public space.




Democratic Governance and European Integration

As the power and scope of the European Union moves further, beyond traditional forms of international cooperation between sovereign states, it is important to analyse how these developments are impacting upon national institutions and processes of democratic representation and legitimacy in the member countries. The Transformation of Governance in the European Union

The book presents a theoretically informed typology of modes of governance which is tested in a careful selection of comparative country and policy studies. At the core is the question whether the European Union is destined to a network type of governance and whether and how this type of governance will be translated into the member states. The individual chapters subject the governing patterns at European and national level to empirical scrutiny. Streeck 2005), only recent events have modified the traditional relation among nation-states. The collapse of the Berlin wall and the downfall of the USSR, the growth of the Pacific Asian economies and the expansion of new communication systems have dissolved the conventional threefold partition of the globe in the idea of a “one world” structured on an axis organised in three principal regional blocks: North America, Western Europe, and Pacific Asia (cf. Taylor/ Flint 2000:4-5). Globalisation has altered all core tasks of the nation-state concerning territoriality, taxation and citizenship. The formulation of policies has shifted from the national context to a complex environment, which embraces the regional and international dimension. These circumstances have affected the representative role of the state as decisional system and have led to a situation, in which sovereignty is shared among multiple actors, who have to deal with new sources of legitimisation beyond the domestic environment (cf. Luhmann 1994:15-20). Thus, traditional foundations for the political order are destabilized due to the fact that “vertically organised national cultures and national economies are gradually being replaced by new horizontal and global networks” (van Ham 2001:37-8). From this angle, the European Union (hereafter also EU or Union) could be conceived as a regional answer to the process of globalisation, in which European integration is adapting European societies, economies and political organisations to a globalised competitive rule system (cf. van Ham 2001). Nevertheless, if the understanding of the EU as a regional variant to globalisation explains the necessity of European integration, it leaves ground for questions regarding the changes in the relationship between governance and government. Moreover, assumed that European integration, owing its intergovernmental bias, is chiefly managed by national executives (cf. Moravcsik 1993), a multi-level system of governance undermines the core functions of governments as principal linkage between the institutional level of decision-making and the society (cf. Poguntke 2000). In this dissertation I will evaluate, at the example of the European Union, the hypothesis that governance has eclipsed government. The intention is to analyse if the European decisional system has destabilized the role of national governments and eroded the classical link between national institutions and society. Furthermore, I will analyse to which degree these supposed changes are to be ascribed to the institutional configuration of the European Union.




National Constitutions in European and Global Governance: Democracy, Rights, the Rule of Law

This two-volume book, published open access, brings together leading scholars of constitutional law from twenty-nine European countries to revisit the role of national constitutions at a time when decision-making has increasingly shifted to the European and transnational level. It offers important insights into three areas. First, it explores how constitutions reflect the transfer of powers from domestic to European and global institutions. Secondly, it revisits substantive constitutional values, such as the protection of constitutional rights, the rule of law, democratic participation and constitutional review, along with constitutional court judgments that tackle the protection of these rights and values in the transnational context, e.g. with regard to the Data Retention Directive, the European Arrest Warrant, the ESM Treaty, and EU and IMF austerity measures. The responsiveness of the ECJ regarding the above rights and values, along with the standard of protection, is also assessed. Thirdly, challenges in the context of global governance in relation to judicial review, democratic control and accountability are examined. On a broader level, the contributors were also invited to reflect on what has increasingly been described as the erosion or ‘twilight’ of constitutionalism, or a shift to a thin version of the rule of law, democracy and judicial review in the context of Europeanisation and globalisation processes. The national reports are complemented by a separately published comparative study, which identifies a number of broader trends and challenges that are shared across several Member States and warrant wider discussion. The research for this publication and the comparative study were carried out within the framework of the ERC-funded project ‘The Role and Future of National Constitutions in European and Global Governance’. The book is aimed at scholars, researchers, judges and legal advisors working on the interface between national constitutional law and EU and transnational law. Informal Governance in the European Union

The study of European integration tends to focus on formal aspects of the integration process: formal decision-making procedures, the role and functioning of institutions, the provisions contained in the treaties, the operation of regulatory regimes in the various policy areas. This is hardly surprising: what is distinctive about the integration process in Europe - what distinguishes integration in Europe from international co-operation in other parts of the world - is the creation and growth of a unique institutional and legal framework structuring the relations between the participating states. An early and still important contribution to the understanding of the integration process has been the 'integration through law' school which regarded the development of a supranational legal order as the key factor in the explanation of the integration process (Cappoletti et al 1986). If the formalisation of inter-state relations is regarded as the essence of the integration process, it is hardly surprising that scholars should concentrate on the formal procedures and the institutionalised arenas for decision-making. However, as has become increasingly evident in the course of recent developments in the European Union, there is an important undercurrent to the formal integration process. This concerns the operation of informal networks which link policy-makers to client groups as well as actors across EU, national and sub-national institutions, and influence (or at least seek to influence) decision-making in the EU. This practice of informal governance is, of course, not a recent phenomenon, but a long-standing dimension of EU politics. This is a recognition that has been reflected by some approaches to European integration: in particular the literature on policy networks and the new institutionalism writing of the 1990s have picked up on the less formal aspects of the EU policy process. Nevertheless, informal governance has never been systematically studied and assessed: this is the void that this volume seeks to fill.
