Globalization processes are propelling a transformation of governance. As political problems become more transnational, public as well as private actors increasingly perform governance activities beyond the level of individual states. This book examines the wide variety of forms that governance can take in the global system and their consequences. An overarching analytical framework is applied to global institutions and initiatives in areas such as trade liberalization, financial market regulation, privacy protection, cybercrime, and food safety.




Mutual Recognition as a New Mode of Governance

Mutual recognition is generally forgotten in debates about new modes of governance, even though it is a particular powerful example. Its invention was crucial for the completion of the European Union’s single market, and in the late 1990s it was transferred to the field of Justice and Home Affairs. Outside of the EU, mutual recognition is also gaining in importance. This book discusses mutual recognition in the context of the debate on new modes of governance and analyzes its potential to solve governance problems, focusing on the preconditions it needs for its functioning (e.g. trust of the Member states), the positive implications of achieving coordination through it, as well as its negative side effects (e.g. the danger of a regulatory race to the bottom). Particular focus is on the contentious services directive as a prominent example of using mutual recognition. In addition, contributions look at the application of mutual recognition in the market for goods, in the area of Justice and Home Affairs, in tax policy, and in the World Trade Organization, so that the book achieves a comprehensive assessment of mutual recognition as a new mode of governance. Lobbying the New President

Presidential transitions offer the chance for new ideas, policies, and people to inhabit the White House. Transitions have triggered policy change for decades and eager interest groups have sought ways to capitalize on this often chaotic phase of US politics. President-Elect Barack Obama declared that lobbyists would be forbidden from serving his transition and issued stiff regulations and rules to limit their access to the planning for his White House. In doing so, Heath Brown asks: Was the role played by Heritage in 1980 and CAP in 2008 indicative of a pattern of influence during the transition phase? Insiders Versus Outsiders

What explains differences in the lobbying behaviour of interest groups? And what consequences do these differences have for the access that interest groups can gain to decision-makers and the influence that they can exert on policy outcomes? Building on an unprecedented amount of empirical evidence on lobbying in Europe, this book puts forward a distinction between lobbying insiders and lobbying outsiders. Lobbying insiders, most prominently business interests, try to establish direct contacts with decision-makers, enjoy good access to executive institutions, and manage to shape policy outcomes when mobilizing the public on an issue is difficult. Lobbying outsiders, in particular citizen groups such as consumer, environmental or health non-governmental organizations, put greater emphasis on mobilizing the public or changing public attitudes, find it easier to gain access to legislative decision-makers, and have the greatest impact on outcomes on issues that are amenable to an outside lobbying campaign. The book shows that a single argument, building on group type as the main variable, can explain variation across interest groups in their choice of strategy, their access to decision-makers, and the conditions under which they can exert influence. Interest Groups and Experimentalist Governance in the EU

This book researches the role that interest groups play in new modes of EU governance, with a specific focus on the role of interest representation in experimentalist governance frameworks. The research is based on four in-depth case studies: the Industrial Emissions Directive, the General Data Protection Regulation, the Combating Child Abuse Directive, and the Institutions for Occupational Retirement Provision Directive.
