Brief View of the Constitution of the United States

Book Description

Excerpt from Brief View of the Constitution of the United States: Addressed to the Law Academy of Philadelphia The method which I have followed to attain the oh jcet which I had in view, is, I believe, entirely new. I do not by any means pretend that it is preferable to that which has been adopted by other writers; I only can say that I found it better suited to my purpose, which I have already explained. Had I written with other and more ambitious views, I would, of course, have endeavoured to adapt my method to them, as our great writers on the constitution have very properly and successfully done. The Constitution of the United States

Book Description

Americans of all political points of view often discuss the U.S. Constitution, but how well do they really know the document and its history? The Constitution the United States: Its Sources and Its Application gives the reader a crash course in the text of the Constitution and its sources. Thomas James Norton was a lawyer who argued before several high courts of appeals, and in this book his goal is to provide an annotated copy of the U.S Constitution so that readers could better understand the reason for each section. As Norton's annotations make clear, one cannot understand the Constitution without understanding the basics of the earlier 'Articles of Confederation', its strengths and weaknesses and why it ultimately failed. The Articles created a weak central government, which The Constitution sought to rectify without tipping the balance too strongly in favour of a mighty centralised government. The footnotes reveal the debate and compromise which led to the passage of each individual clause. Key historical moments, such as the reign of King Charles I of England and the Short Parliament, are added to the text to explain how they shaped the attitudes of the men who wrote the Constitution. Norton also discuses the governments of Australia, France, Canada and Brazil for comparative purposes, which really enriches the experience for readers who are not well versed in comparative government. These explanations are brief, which keeps the book moving at a brisk pace. Norton occasionally expresses strong opinions about historical events which may not be in line with how American constitutional history actually unfolded in the future, but his opinions do not interfere with the usefulness of the book. The Constitution the United States: Its Sources and Its Application is not overly technical and does not rely strictly on legal language. This makes the book digestible by everyone, from lawyers to historians to people interested in politics. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. The Constitution and Public Opinion (Classic Reprint)

Book Description

Excerpt from The Constitution and Public Opinion I. Extreme rigidity in our federal and state constitutions. Amendment is made as difficult as possible; in some states it is practically impossible. The assumption of constitution makers seems to have been that eternal wisdom was possessed by the generation entrusted with the making of the constitution, and that the results of their labors should be crystallized into perma nent, unchanging form. This is the classic rights argument, in which the seat of the federal government is the creation of the states, not the reverse.

Political and Constitutional Law of the United States of America (Classic Reprint)

Book Description

Excerpt from Political and Constitutional Law of the United States of America The principles fundamental to political self-government, should doubtless be clearly understood by every vo'rnn or macros. For his status, in this country, is no less than that of one of a body of absolute sovereigns.l The three fundamentally different and mu tually opposing theories of our political system, - one or another of which every voter must necessarily sanction, and consequently, -one or another of which must furnish the key to every administra tion of government, state and federal, - are therefore severally and distinctly presented, so that every voter may judge for himself, as he ought to do, which of these theories should receive his assent and support. Attention is also directed to the different foundations of govern ment, to the rise and development of the system peculiar to Amer ica, to the sovereign legislation by the People themselves from the dawn of the Revolution to the xvth Amendment, and to the views and doctrines of the original framers of our Constitutions; ever so little reflection upon which will enable any voter to form his own independent opinion, regardless of partisan strifes, and to cast his vote with a clear understanding of what it involves. He was the son of Henry St George Tucker, President of the Court of Appeals of Virginia, and grandson of St. George Tucker, also a member of that court, and who was the author of "Tucker's Blackstone," the first commentary on the Constitution of the United States. During a long and active professional career, the author served for eight years as Attorney-General of Virginia and for twelve years as a Representative in Congress, daring four years of which service he was Chairman of the Judiciary Committee of the House. From early life a close student of the Constitution and of the constitutional history of the United States, he had long cherished a purpose to write a commentary on the Constitution. His eminent public career brought him into living contact with many great questions on which he had read and thought deeply; and on his retirement from Congress in 1887 he hoped to take up his long-meditated work.
