The Duty to Investigate in Situations of Armed Conflict


Book Description

This book explores the duty to investigate potential violations of the law during armed conflict, and does so under international humanitarian law (IHL), international human rights law (IHRL), and their interplay. Through a meticulous comparative legal analysis, it maps out the scope and contents of investigative obligations. On the basis of general international law, it also develops and applies a novel and more broadly applicable step-by-step methodology for resolving issues of interplay between both legal regimes. In doing so, this study clarifies the scope of application and contents of investigative obligations under both legal regimes, as well as for situations to which both apply. The book finds that the oft-heard narrative that to require States to conduct human rights investigations during armed conflict would be wholly unrealistic in light of the realities of hostilities is unfounded and in need of revision.

LGBT rights have become increasingly salient within the EU enlargement process as a litmus test for Europeanness. But the promotion of these norms has provided a basis for political contestation. This book interrogates the normative dimensions of the EU enlargement process, with special reference to LGBT politics. Reconceptualising Europeanisation, it argues that EU enlargement is a process of negotiated transformation in which EU policies and norms are (re)defined, translated and transformed. Empirically, it analyses the promotion of and resistance to LGBT equality norms in Serbia’s EU integration process, but it looks beyond policies to the impact of the negotiated transitions on lived experiences. Overall, the book raises important questions about the political and social consequences of Europeanisation. At its heart is one crucial question: what do we consider progress?




Practice Theory and International Relations

Are social practices actions, or institutional frameworks of interaction structured by common rules? How do social practices such as signing a cheque differ from international practices such as signing a peace treaty? Traversing the fields of international relations (IR) and philosophy, this book defends an institutionalist conception of practices as part of a general practice theory indebted to Oakeshott, Wittgenstein and Hegel. The proposed practice theory has two core aspects: practice internalism and normative descriptivism. In developing a philosophical analysis of social practices that has a special relevance for international relations, Silviya Lechner and Mervyn Frost depart from Pierre Bourdieu's sociology of practice that dominates the current 'practice turn' in IR. The authors show that the contemporary global realm is constituted by two distinct macro practices - the practice of sovereign states and that of global rights.




The Role of Multilateral Environmental Agreements

The environment suffers enormously during armed conflicts and, despite the increasing awareness of the pressing need to protect the planet, devastating environmental damage can occur legally at times of war. This book suggests that – apart from the protection offered under law of armed conflict – environmental treaties or multilateral agreements (MEAs) can complement and strengthen environmental protection when war occurs. Previous research has focused on the protection offered under the law of armed conflict (in particular international humanitarian law) and customary international environmental law concerning wartime environmental damage, or whether environmental treaties remain applicable at times of armed conflict. This book, however, is the first in-depth scholarly examination of how environmental treaties can apply in wartime and how they can contribute to the protection of the environment in relation to armed conflict. It also offers an updated study of environmental protection under the law of armed conflict, including the latest developments in the International Law Commission's work on this underexplored topic.

Environmentalism and Global International Society reveals how environmental values and ideas have transformed the normative structure of international relations. Falkner argues that environmental stewardship has become a universally accepted fundamental norm, or primary institution, of global international society. He traces the history of environmentalism's rise from a loose set of ideas originating in the nineteenth century to a globally applicable norm in the twentieth century, which has come to redefine international legitimacy and states' global responsibilities. He shows how this deep norm change came about as a result of the interplay between non-state and state actors, and how the new environmental norm has interacted with the existing primary institutions of global international society, most notably sovereignty and territoriality, diplomacy, international law, and the market.
