Evidence of the custom of bankers of a particular place to borrow money on time notes is admissible to show that the execution of such a note by a banking firm of that place would be in the ordinary course of business. 1 Same--authority Of Agent--Private Letter Op Advice Admissible To Show. Where a firm sent to its correspondent a list of persons authorized to sign the firm name, the list is admissible in evidence as an admission to show that one of the persons mentioned had authority to sign the firm name generally, although it is shown that this list was a private paper forwarded to the bank for its sole use. This latter fact goes to the force, but not to the admissibility, of the evidence. The jury should be Instructed that such a list does not necessarily constitute a general power to sign the firm name. 3. Same--Fraudulent Execution Op Notes Inadmissible.
