This book focusses on the debates concerning aspects of intellectual property law that bear on access to medicines in a set of developing countries. Specifically, the contributors look at measures that regulate the acquisition, recognition, and use of patent rights on pharmaceuticals and trade secrets in data concerning them, along with the conditions under which these rights expire so as to permit the production of cheaper generic drugs. In addition, the book includes commentary from scholars in human rights, international institutions, and transnational activism. The case studies presented from 11 Latin American countries, have many commonalities in terms of economics, legal systems, and political histories, and yet they differ in the balance each has struck between proprietary interests and access concerns. The book documents this cross-country variation in legal norms and practice, identifies the factors that have led to differences in result, and theorizes as to how differentials among these countries occur and why they endure within a common transnational regulatory regime. The work concludes by putting the results of the investigations into a global administrative law frame and offers suggestions on institutional mechanisms for considering the trade-offs between health and wealth.

The Domestic Politics of International Trade considers the issues surrounding intellectual property rights in international trade negotiations in order to examine the challenges posed to domestic policy-makers by the increasingly broad nature of Free Trade Agreements (FTAs). Throughout the book the author demonstrates the importance of domestic politics in understanding the nature and outcome of international negotiations, particularly as they relate to international economic diplomacy. The book looks in detail at the intellectual property negotiations which formed part of the US-Peru and US-Colombia Free Trade Agreements and analyses the extent to which public health authorities and other parties affected by the increased levels of intellectual property protection were integrated into the negotiation process. The book then juxtaposes these findings with an analysis of the domestic origins of US negotiation objectives in the field of intellectual property, paying particular attention to the role of the private sector in the development of these objectives. Based on a substantial amount of empirical research, including approximately 100 interviews with negotiators, capital based policy-makers, private sector representatives, and civil society organisations in Lima, Bogotá and Washington, DC, this book offers a rare account of different stakeholders’ perceptions of the FTA negotiation process. Ultimately, the book succeeds in integrating the study of domestic politics with that of international negotiations. The book is the first attempt to investigate how and to what extent authoritarian (personalistic) regimes fail to provide fundamental goods and services. For two decades, Russian authorities spent much effort and money to improve health administration, but most success stories are borderline fake. The failure is by design; because personalistic regimes rely on personalized exchanges and bargains instead of impersonal rules and permanent organizations, all actors put self-interest ahead of patients’ needs. It is a severe problem because authoritarian principals proclaim social betterment as their central goal -- and many Russians take such claims at face value -- but incentivize their agents to imitate progress and tolerate slipshod performance. The benefits of this investigation are three-fold. First, the book provides an analytical framework of bad governance rooted in the rational institutionalist tradition and connected to competence-control theory. Second, it gives a general readership interested in how Russia works a sense of the key political players’ mindset and the regime-induced constraints under which elites operate. Third, although the book investigates health governance exclusively, its analytical framework is portable to other issue areas and could be applied to explain how and why Russia evolved into an ineffective, coercive, and predatory state under Putin’s leadership.

Study of the 1963/4 typhoid outbreak, highlighting issues and debates which are strikingly relevant today. The problem of food poisoning and food-borne infections is currently one of vigorous debate, highlighted since the 1980s by numerous outbreaks and scares involving salmonella in lettuce and eggs, listeria in cheese, the links between vCJD and BSE, E.Coli 0157 in cooked meats, and foot and mouth disease. Yet, as this book shows, the various issues involved were important as early as 1963/4, when there were serious typhoid outbreaks in Harlow, South Shields, Bedford, and Aberdeen, traced to contaminated corned beef imported from Argentina. Based upon extensive research, using archives which have only recently become available, private papers, and interviews as well as secondary literature, the book analyses the course of the outbreak and looks at the responses of politicians, officials, health professionals, business interests, the media and the public. It also considers the difficult issue of the weighing offood safety against international trade and other business and economic interests; conflicts between government departments; rivalry between professionals such as doctors and veterinarians; the effects upon and influence of victims and local communities; and the conduct of and responses to an official enquiry. Overall, it draws out generic lessons for how such epidemics should be handled, adding an historical perspective to contemporary debates.

Chasing Dragons reconsiders the meaning of security. Additionally, it discusses avenues for resisting the insecurity produced by liberal states in the post-9/11 world. This critical approach reveals the pervasiveness of power in contemporary Canadian society, how this power is hidden, and the consequences for progressive social politics. Canada has received significant attention of late for initiating a government-sponsored medical marijuana program and for its flirtation with marijuana decriminalization. At best, these initiatives have contributed to Canada being seen as a reluctant ally by Washington, and, at worst, as a potential threat. The result of this impression is increasing American pressure to adopt more robust domestic security policies. At the same time, the Canadian public sees itself as holding unique values that differ from those held by its neighbour to the south. Supposedly these values are best reflected by a distinctive security outlook which produces reasonable responses to potential threats, a sharp contrast to the manic actions of the United States. Chasing Dragons challenges these presumptions of difference and exposes the security politics and policy that they make possible. Focusing on the issues surrounding illicit drugs, Kyle Grayson examines how discourses and practices of security policy actually contribute to the construction of Canadian national and cultural identity. This analysis is also relevant beyond Canada. Crucially, this book identifies the dangers of underestimating the centrality of race and geopolitics to civic conceptions of nationality in liberal societies.
