Law and Governance in an Enlarged European Union


Book Description

This book's principal aim is to critically address the institutional and substantive legal issues resulting from European enlargement, chiefly those relating to the legal foundations on which the enlarged Union is being built. The accession of new Member States creates the potential for a stronger and more powerful Europe. Realising this potential, however, will depend on the ability of the EU to develop functional and effective governance structures, both at the European level and at the level of the individual Member States. While the acquis communautaire will ensure that formal laws in the new Member States will be aligned with those of existing members, the question remains as to how effective institutions will be in implementing changes, and what effects the imposed changes will have on the legitimacy of the new legal framework. This book, containing the work of leading scholars in law and social sciences, examines the current and future legal framework for EU governance, and the role that new members will - or will not - play in the creation of that framework, paying particular attention to the specific challenges membership in the EU poses to the acceding states of Central and Eastern Europe. It is a book which will contribute to and influence debates over constitutionalism and legal harmonisation in the EU.




Converging Europe

'Converging Europe' evaluates the impact of European integration on social policy development since the launch and re-launch of the Lisbon strategy discussing the challenges posed by the still unfolding global economic crisis of 2007-2009. Employment Policies and Multilevel Governance

In Europe, work has long been a symbol of full citizenship and today work is a fundamental goal of European social policy. However, although every person has the ‘right’ to work, it is becoming clearer all the time that unemployment is not due merely to a lack of encouragement to exercise this right, but (at least in part) to some deeper defects in the implementation of effective employment policies. As a contribution to defining the nature of these problems this important collection of essays targets the phenomena of multilevel governance, both vertical (European, national, regional, local) and horizontal (administrative institutions, trade unions, business representatives, NGOs), showing, with detailed analysis and data, how coordination or conflict between the various levels advances, or fails to advance, the goals of employment policy. Regarding the EU, five EU Member States are examined– plus, for comparative analysis, the parallel Canadian federal model – with the authors addressing such concrete issues as: the impact of globalisation and Europeanisation on employment policies; distribution of tasks in the Open Method of Coordination (OMC); involvement of private and economic agents; the increasing significance of international political agents; flexicurity as an employment strategy; the difficulty of integrating the excluded; coordination with education and fiscal policies; social inclusion from the point of view of international human rights; and gender ‘mainstreaming’ as a weakening of the EU guarantee of gender equality. The essays originated in a research meeting held at the Instituto Internacional de Sociología Jurídica at Oñati (Spain) in June of 2007. Some of the contributors, all employment law experts, discuss problematic aspects of the European Employment Strategy (EES) and its influence on the decentralization of employment policies and related elements of social protection. Other authors concentrate on ‘built-in’ multilevel problems resulting from existing constitutional and administrative structures, while a third group focuses on substantive approaches to employment policies within individual member states. Enabling Social Europe

‘Enabling Social Europe’ examines how the paradigm of the ‘enabling welfare state’ might offer a new perspective for European social policy in the decades to come. The ‘enabling’ concept is perceived as going beyond that of mere ‘activation’, thus also embracing policies aimed at increasing personal autonomy, individual responsibility and social inclusion by endowing individuals with the resources and capabilities needed to manage and balance their life courses in a better way. The study is distinguished by a unique collaboration of social and economic policy experts coming from a wide range of disciplines: economics, law, sociology, political science, and philosophy. The authors seek to shed new light on whether European social policy ought to play a role in the future and, if so, what sort of role that could be. They convincingly argue that despite an implicit normative consensus on the ‘European social model’, there is still room for a multifaceted world in which welfare regimes can maintain their own path-dependent ways of achieving a fair and just society with a high level of welfare for all. The empirical part of the book contains an appraisal of policies and reforms with a view to the ‘enabling welfare state’ approach in four important policy areas: health care, old-age security, family policy, and poverty prevention.
