Restructuring of the National Offender Management Service

The National Offender Management Service directly manages 117 public prisons, manages the contracts of 14 private prisons, and is responsible for a prisoner population of around 86,000. It commissions and funds services from 35 probation trusts, which oversee approximately 165,000 offenders serving community sentences. For 2012-13, the Agency's budget is £3,401 million. The Agency achieved its savings targets of £230 million in 2011-12 and maintained its overall performance, despite an increase in the prison population. However, the Agency's savings targets of £246 million in 2012-13, £262 million in 2013-14 and £145 million in 2014-15 are challenging. The Agency believes it has scope to make the prison estate more efficient by closing older, more expensive prisons and investing in new ones. These plans, however, assume the prison population will stay at its current level. Furthermore, the Agency has not yet secured the up-front funding for the voluntary redundancies needed to bring down prison staffing costs. Unless overcrowding is addressed and staff continue to carry out offender management work it is increasingly likely that rehabilitation work needed to reduce the risk of prisoners reoffending will not be provided. The Agency has not done enough to address the risks to safety, decency and standards in prisons and in community services arising from staffing cuts implemented to meet financial targets. The Agency plans to increase the role of private firms and the third sector in probation but the probation trusts don't appear to have the infrastructure and skills they need to commission probation services from these providers effectively




Restructuring of the National Offender Management Service

The National Offender Management Service, an Executive Agency of the Ministry of Justice, faces substantial financial and operational challenges, including a vulnerability to unexpected changes in the prison population. The Service achieved value for money in 2011-12, as it hit its savings target of £230 million while restructuring its headquarters and it has broadly maintained its performance, such as in reducing reoffending. As a result of some sentencing reforms not going ahead, the Ministry of Justice lost around £130 million of savings. Given the loss of these reforms, the prison population is now unlikely to fall significantly over the next few years, which limits the plans to close older, more expensive, prisons and bring down costs. The savings target for 2012-13 of a further £246 million is challenging and an overspend of £32 million is forecast. The Service currently has a £66 million shortfall in the £122 million needed over the next two years to fund early staff departures aimed at bringing long-term reductions in its payroll bill. The Service has restructured its headquarters, reducing staff numbers by around 650 from around 2,400. Most stakeholders generally regarded the restructure positively, considering it produced a more efficient organisation with greater clarity on accountability. The Service relies on the probation profession to deliver reforms and to reduce costs, but there are some tensions in the relationship. The NAO recommends the Service continues to engage with probation trusts to address their perception it lacks understanding of probation issues.

Privatising Public Prisons


Book Description

Successive UK governments have pursued ambitious programmes of private sector competition in public services that they promise will deliver cheaper, higher quality services, but not at the expense of public sector workers. The public procurement rules (most significantly Directive 2004/18/EC) often provide the legal framework within which the Government must deliver on its promises. This book goes behind the operation of these rules and explores their interaction with the Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE); regulations that were intended to offer workers protection when their employer is restructuring his business. The practical effectiveness of both sources of regulation is critiqued from a social protection perspective by reference to empirical findings from a case study of the competitive tendering exercise for management of HMP Birmingham that was held by the National Offender Management Service (NOMS) between 2009 and 2011. Overall, the book challenges the Government's portrayal of competition policies as self-evident sources of improvement for public services. It highlights the damage that can be caused by competitive processes to social capital and the organisational, cultural and employment strengths of public services. Its main conclusions are that prison privatisation processes are driven by procedure rather than aims and outcomes and that the complexity of the public procurement rules, coupled with inadequate commissioning expertise and organisational planning, can result in the production of contracts that lack aspiration and are insufficiently focused upon improvement or social sustainability. In sum, the book casts doubt upon the desirability and suitability of using competition as a policy mechanism to improve public services.

Women offenders


Book Description

Government plans to introduce payment-by-results in probation services need to be redesigned in respect of women offenders-who are often classified as presenting a lower risk of reoffending-so that they receive the intensive tailored support they need. The Government's strategic priorities for women offenders lack substance and in particular must take a broader approach to supporting women at risk of reoffending and addressing the inter-generational nature of crime. The Committee welcomes the Government's extension of through the gate statutory support to prisoners sentenced to less than 12 months, likely to benefit many women offenders. However, potential providers of rehabilitative services need to recognise that levels of risk posed by women may not reflect the level of support such women require. Although progress has been made since the Corston recommendations, a number of concerns remain: the women's prison population has not fallen sufficiently fast; over half of women offenders continue to receive ineffective short-custodial sentences; mental health and substance misuse treatment which could reduce use of custody remains unavailable to Courts in sufficient volume. Maintaining a network of women's centres and using residential alternatives to custody are likely to be more effective and cheaper in the long run than short custodial sentences. The Committee does not recommend substantive changes to the overall sentencing framework, but argues instead for more emphasis to be placed on ensuring courts are provided with robust alternatives to custody specifically appropriate to women




Probation Practice and the New Penology

The criminal justice system has been in a state of flux in recent decades, accompanied by growing levels of insecurity and intolerance of crime and offenders among the general population.
