Book Description

Review of New Sources and Modifications in Indian Country (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Review of New Sources and Modifications in Indian Country (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 The EPA is finalizing a Federal Implementation Plan (FIP) under the Clean Air Act (CAA or Act) for Indian country. The FIP includes two New Source Review (NSR) regulations for the protection of air resources in Indian country. The first rule applies to new and modified minor stationary sources (minor sources) and to minor modifications at existing major stationary sources (major sources) throughout Indian country. The second rule (nonattainment major NSR rule) applies to new and modified major sources in areas of Indian country that are designated as not attaining the National Ambient Air Quality Standards (NAAQS). These rules will be implemented by EPA or a delegate Tribal agency assisting EPA with administration of the rules, until replaced by an EPA-approved implementation plan. New Sources and Modifications in Indian Country - Federal Indian Country Minor New Source Review - Amendments, Us Environmental Protection Agency Regulation, 2018

Book Description

New Sources and Modifications in Indian Country - Federal Indian Country Minor New Source Review - Amendments (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the New Sources and Modifications in Indian Country - Federal Indian Country Minor New Source Review - Amendments (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 The Environmental Protection Agency (EPA) is issuing final amendments to the federal minor New Source Review (NSR) program in Indian country. We refer to this NSR rule as the "federal Indian country minor NSR program." We are amending this rule in two ways. First, we are expanding the list of emissions units and activities that are exempt from the federal Indian country minor NSR program by adding several types of low-emitting units and activities. Second, we have clarified construction-related terms by defining "commence construction" and "begin construction" to better reflect the regulatory requirements associated with construction activities. We believe both of these changes will simplify the program, and result in less burdensome implementation without detriment to air quality in Indian country. Finally, we have reconsidered the advance notification period for relocation of a true minor source in response to a petition on the rule from the American Petroleum Institute, the Independent Petroleum Association of America and America's Natural Gas Alliance, but we are not changing that provision. Review of New Sources and Modifications in Indian Country - Amendments to the Registration and Permitting Deadlines for True Minor Sources (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Review of New Sources and Modifications in Indian Country - Amendments to the Registration and Permitting Deadlines for True Minor Sources (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 EPA is issuing final amendments to the "Federal Minor New Source Review Program in Indian Country" (we refer to this new source review rule as the "Indian Country Minor NSR Rule"). We are amending the Indian Country Minor NSR Rule in two ways. First, we are extending the NSR minor source permitting deadline for true minor sources in the oil and natural gas sector from September 2, 2014, to March 2, 2016. Second, we are changing the registration deadline for new true minor sources in the oil and natural gas sector to conform with the changes to the NSR minor source permitting deadline. We are also eliminating a requirement for all true minor sources that begin operation before September 2, 2014, to obtain a minor NSR permit 6 months after EPA publishes a general permit because the provision no longer affects any source. Federal Implementation Plans - True Minor Sources in Indian Country in the Oil and Natural Gas Production and Natural Gas Processing Segments (Us Environmental Protection Agency Regulation) (Epa) (2018 Edition)

Book Description

Federal Implementation Plans - True Minor Sources in Indian Country in the Oil and Natural Gas Production and Natural Gas Processing Segments (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Federal Implementation Plans - True Minor Sources in Indian Country in the Oil and Natural Gas Production and Natural Gas Processing Segments (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 The Environmental Protection Agency (EPA) is finalizing a federal implementation plan (FIP) that applies to new true minor sources and minor modifications at existing true minor sources in the oil and natural gas production and natural gas processing segments of the oil and natural gas sector that are locating or expanding in Indian reservations or in other areas of Indian country over which an Indian tribe, or the EPA, has demonstrated the tribe's jurisdiction. The FIP satisfies the minor source permitting requirement under the "Federal Minor New Source Review (NSR) Program in Indian Country" (referred to as the "Federal Indian Country Minor NSR rule"). For the oil and natural gas production and natural gas processing segments of the oil and natural gas sector, the FIP requires compliance with emission limitations and other requirements from certain federal emission standards as written at the time of construction or modification for compression ignition and spark ignition engines; process heaters; combustion turbines; fuel storage tanks; glycol dehydrators; completion of hydraulically fractured oil and natural gas wells; reciprocating and centrifugal compressors (except those located at well sites); pneumatic controllers; pneumatic pumps; storage vessels; and fugitive emissions from well sites, compressor stations and natural gas processing plants. Nonattainment New Source Review, Us Environmental Protection Agency Regulation, 2018

Book Description

Nonattainment New Source Review (NSR) (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Nonattainment New Source Review (NSR) (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 The EPA is finalizing revisions to the regulations governing the nonattainment new source review (NSR) program mandated by section 110(a)(2)(C) of the Clean Air Act (CAA or Act). These revisions implement changes to the preconstruction review requirements for major stationary sources in nonattainment areas in interim periods between designation of new nonattainment areas and adoption of a revised State Implementation Plan (SIP). The revisions conform the nonattainment permitting rules that apply during the SIP development period following nonattainment designations before SIP approval to the Federal permitting rules applicable to SIP-approved programs. The changes are intended to provide a consistent national program for permitting major stationary sources in nonattainment areas under section 110(a)(2)(C) and part D of title I of the Act. In particular, these changes conform the regulations to the NSR reform provisions that EPA promulgated by notice dated December 31, 2002, except that these changes do not include the NSR reform provisions for "clean units" or "pollution control projects," which the U.S. Court of Appeals for the D.C. Circuit vacated in New York v. EPA, 413 F.3d 3 (DC Cir. 2005). In addition, these changes include an interim interpretation of the NSR reform provision for a "reasonable possibility" standard for recordkeeping and reporting requirements, in accordance with that court decision. This interim interpretation to the "reasonable possibility" standard applies for appendix S purposes, pending the completion of rulemaking to develop a more complete interpretation. Approvals and Promulgations of Implementation Plans - Revisions to Nevada State Implementation Plan - Stationary Source Permits (Us Environmental Protection Agency Regulation) (Epa) (2018 Edition)

Book Description

Approvals and Promulgations of Implementation Plans - Revisions to Nevada State Implementation Plan - Stationary Source Permits (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Approvals and Promulgations of Implementation Plans - Revisions to Nevada State Implementation Plan - Stationary Source Permits (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 EPA is finalizing a limited approval and limited disapproval of revisions to the applicable state implementation plan for the State of Nevada. The revisions include new or amended State rules governing applications for, and issuance of, permits for stationary sources, but not including review and permitting of major sources and major modifications under parts C and D of title I of the Clean Air Act. EPA is taking this action under the Clean Air Act obligation to take action on State submittals of revisions to state implementation plans. The intended effect of the limited approval and limited disapproval action is to update the applicable state implementation plan with current State rules with respect to permitting, and to set the stage for remedying deficiencies in the permitting rules with respect to certain new or revised national ambient air quality standards. This limited disapproval action would not trigger sanctions under section 179 of the Clean Air Act but does trigger an obligation on EPA to promulgate a Federal Implementation Plan unless the State of Nevada corrects the deficiencies, and EPA approves the related plan revisions, within two years of the final action. Prevention of Significant Deterioration and Nonattainment New Source Review - Reasonable Possibility in Recordkeeping (Us Environmental Protection Agency Regulation) (Epa) (2018 Edition)

Book Description

Prevention of Significant Deterioration and Nonattainment New Source Review - Reasonable Possibility in Recordkeeping (US Environmental Protection Agency Regulation) (EPA) (2018 Edition) The Law Library presents the complete text of the Prevention of Significant Deterioration and Nonattainment New Source Review - Reasonable Possibility in Recordkeeping (US Environmental Protection Agency Regulation) (EPA) (2018 Edition). Updated as of May 29, 2018 This rule finalizes proposed revisions to the regulations governing the major new source review (NSR) programs mandated by parts C and D of title I of the Clean Air Act (CAA). These changes clarify the "reasonable possibility" recordkeeping and reporting standard of the 2002 NSR reform rules. The "reasonable possibility" standard identifies for sources and reviewing authorities the criteria under which an owner or operator of a major stationary source undergoing a physical change or change in the method of operation that does not trigger major NSR permitting requirements must keep records. The standard also specifies the recordkeeping and reporting requirements on such sources. As noted in the proposal, the U.S. Court of Appeals for the DC Circuit in New York v. EPA, 413 F.3d 3 (DC Cir. 2005) (New York) remanded for the EPA either to provide an acceptable explanation for its "reasonable possibility" standard or to devise an appropriately supported alternative. To satisfy the Court's remand, the EPA is clarifying what constitutes "reasonable possibility" and when the "reasonable possibility" recordkeeping requirements apply.
