Does the United States have the right to defend itself by striking first, or must it wait until an attack is in progress? Is the Bush Doctrine of aggressive preventive action a justified and legal recourse against threats posed by terrorists and rogue states? Tackling one of the most controversial policy issues of the post-September 11 world, Michael Doyle argues that neither the Bush Doctrine nor customary international law is capable of adequately responding to the pressing security threats of our times. In Striking First, Doyle shows how the Bush Doctrine has consistently disregarded a vital distinction in international law between acts of preemption in the face of imminent threats and those of prevention in the face of the growing offensive capability of an enemy. Taking a close look at the Iraq war, the 1998 attack against al Qaeda in Afghanistan, and the Cuban Missile Crisis, among other conflicts, he contends that international law must rely more completely on United Nations Charter procedures and develop clearer standards for dealing with lethal but not immediate threats. After explaining how the UN can again play an important role in enforcing international law and strengthening international guidelines for responding to threats, he describes the rare circumstances when unilateral action is indeed necessary. Based on the 2006 Tanner Lectures at Princeton University, Striking First includes responses by distinguished political theorists Richard Tuck and Jeffrey McMahan and international law scholar Harold Koh, yielding a lively debate that will redefine how--and for what reasons--tomorrow's wars are fought.

Are strikes going out of fashion or are they an inevitable feature of working life? This is a longstanding debate. The much-proclaimed withering away of the strike in the 1950s was quickly overturned by the resurgence of class conflict in the late 1960s and 1970s. The period since then has been characterized as one of labor quiescence. Commentators again predict the strikes demise, at least in the former heartlands of capitalism.Patterns of employment are constantly changing and strike activity reflects this. The continuing decline of manufacturing in mature industrialized economies is of major importance here (though the global relocation of manufacturing may lead to some relocation of strikes). Simultaneously, we see the growth of disputes in the service sector (the tertiarization of strikes). This is evident particularly in public services, including health care, social care and education, and is accompanied by a feminization of strikes, given the prevalence of women working there. This unique study draws on the experience of fifteen countries around the world: South Africa, Argentina, Canada, Mexico, United States, Korea, Australia, New Zealand, Belgium, Denmark, France, Germany, the Netherlands, Sweden and the United Kingdom. Covering the high and low points of strike activity over the period 1968-2005, the study shows continuing evidence of the durability, adaptability and necessity of the strike.

Railways in the Netherlands

This book traces the origin, growth, decline, and resurrection of the railway system of the Netherlands from its beginnings to privatization in the 1990s, and places its history in the context of the political and socioeconomic development of the country. At first, the largely agrarian and mercantile Dutch society saw little use for such a novel system of transportation, thanks to a highly developed system of roads and waterways. However, the success of early English railways did not go unnoticed, and in 1834 a plan was developed for a railway from Amsterdam to the Prussian Ruhr area to replace the transportation system along the Rhine River. Although this initial plan was finally abandoned, other lines were opened in 1839. The technology was largely borrowed from England and Belgium, but from the outset Dutch engineers played an important role in the development of the network. Apart from a short-lived state system, the first railways were built and operated by private companies, but when this did not result in an efficient network, the state stepped in again in 1860 to bring coherence. By 1900, the national network was complete, but labor unrest escalated, leading to the national strike of 1903, which reverberated for many years in the Dutch Parliament, railroad board rooms, and socialist political parties. The exigencies of World War I increased the grip of the state on the railways, which ultimately resulted in 1938 in the complete unification of the railways, albeit under public ownership. In the 1920s and 1930s, competition from other forms of transportation resulted in a curtailing of services and the closing of unprofitable lines. World War II devastated the Dutch railway system and necessitated an almost complete rebuilding. In the postwar era, population growth, greater mobility, pollution problems, and lack of space for new highways led to an intensive use of existing railways and the construction of new lines to link new suburbs and airports with the existing network. The privatization craze of the 1990s separated the ownership of the network from its operations, but the final relationship has yet to be established.

The proper construction of the compensation clause of the Constitution has emerged as the central legal issue of the environmental revolution, as property owners have challenged a steady stream of environmental statutes that have cut deeply into traditional notions of property rights. When may they justly demand that the state compensate them for the sacrifices they are called upon to make for the common good? Ackerman argues that there is more at stake in the present wave of litigation than even the future shape of environmental law in the United States. To frame an adequate response, lawyers must come to terms with an analytic conflict that implicates the nature of modern legal thought itself. Ackerman expresses this conflict in terms of two opposed ideal types--Scientific Policymaking and Ordinary Observing--and sketches the very different way in which these competing approaches understand the compensation question. He also tries to demonstrate that the confusion of current compensation doctrine is a product of the legal profession's failure to choose between these two modes of legal analysis. He concludes by exploring the large implications of such a choice--relating the conflict between Scientific Policymaking and Ordinary Observing to fundamental issues in economic analysis, political theory, metaethics, and the philosophy of language.
