Los dos trabajos publicados en este libro discuten temas actuales relacionados con actividades terroristas desde un punto de vista del derecho penal internacional así como del derecho penal material y procesal penal. El primer texto analiza, a partir de los casos polémicos de la bomba de tiempo (ticking bomb) y de un reciente caso de secuestro en Alemania (caso Daschner), si la prohibición absoluta de la tortura puede realmente mantenerse en situaciones extremas en las cuales su uso podría ser el único medio de obtener la información necesaria para prevenir daños (de aún mayor gravedad) a personas inocentes. El segundo artículo examina si el uso transnacional de prueba obtenida por medio de tortura, es decir, el uso de prueba obtenida en el extranjero por un Estado o Partes en juicios criminales, lleva consigo una prohibición (absoluta) de utilización de esta prueba en el proceso nacional.
