THE CONTEMPORARY postnormal world is posing for Muslims ever strange ethical, financial, and medical dilemmas for which modern jurists are expected to provide a suitable theological response. Yet even with an encyclopedic knowledge of Islamic law, the task facing them is daunting. In the real world this level of complexity has led to chaos in fatwa issuance with many scholars voicing concern at the direction to which things are moving and calling for the process to be regulated. This book critiques fatwa issuance in the modern context and calls for application of a synthesized approach using the mechanism of collective ijtihad to formulate rulings and overcome current weaknesses. It carefully examines central juristic concepts and puts forward consultative ijtihad as a viable alternative to the controversial classical ijma' approach which may be difficult to realize in the contemporary world. The author argues that fatwas become questionable when jurists, out of their depth, fail to grasp concepts which only engagement with specialists can fully elucidate, or give way to top down financial and/or political pressure from the executives of institutions employing them. Matters are compounded by the face of fatwas having undergone a radical transformation in modern times with online programs and social media often a go-to source for Muslims. The author exposes the world of modern fatwa pronouncements – packaged, supplied and broadcast in a matter of minutes, under a mentality of one-fatwa-fits-all. In a bid for much needed reform he calls for a reassessment of current institutional practices contending that Muslim societies need not be vulnerable to the demands of a media driven, technocratic age, with rapid shifts in ethical norms, but that, in the interests of a healthy functioning society, issue fatwas cognizant of the wider modern context, specialist knowledge, as well as the cultural diversity that exists in the common Ummatic identity.

Broadening an overly narrow definition of Islamic journalism, Janet Steele examines day-to-day reporting practices of Muslim professionals, from conservative scripturalists to pluralist cosmopolitans, at five exemplary news organizations in Malaysia and Indonesia. At Sabili, established as an underground publication, journalists are hired for their ability at dakwah, or Islamic propagation. At Tempo, a news magazine banned during the Soeharto regime and considered progressive, many see their work as a manifestation of worship, but the publication itself is not considered Islamic. At Harakah, reporters support an Islamic political party, while at Republika they practice a “journalism of the Prophet” and see Islam as a market niche. Other news organizations, too, such as Malaysiakini, employ Muslim journalists. Steele, a longtime scholar of the region, explores how these publications observe universal principles of journalism through an Islamic idiom.




Piety and Public Opinion

Across the Muslim world, religion plays an increasingly prominent role in both the private and public lives of over a billion people. Observers of these changes struggle to understand the consequences of an Islamic resurgence in a democratizing world. Will democratic political participation by an increasingly religious population lead to victories by Islamists at the ballot box? Will more conspicuously pious Muslims participate in politics and markets in a fundamentally different way than they had previously? Will a renewed attention to Islam lead Muslim democracies to reevaluate their place in the global community of states, turning away from alignments with the West or the Global South and towards an Islamic civilizational identity? The answers to all of these questions depend, at least in part, on what ordinary Muslims think and do. In order to provide these answers, the authors of this book look to Indonesia--the world's largest Muslim country and one of the world's only consolidated Muslim democracies. They draw on original public opinion data to explore how religiosity and religious belief translate into political and economic behavior at the individual level. Across various issue areas--support for democracy or Islamic law, partisan politics, Islamic finance, views about foreign engagement--they find no evidence that the religious orientations of Indonesian Muslims have any systematic relationships with their political preferences or economic behavior. The broad conclusion is that scholars of Islam, in Indonesia and elsewhere, must understand religious life and individual piety as part of a larger and more complex set of social transformations. These transformations include modernization, economic development, and globalization, each of which has occurred in parallel with Islamic revivalism throughout the world. Against the common assumption that piety would naturally inhibit any tendencies towards modernity, democracy, or cosmopolitanism, Piety and Public Opinion reveals the complex and subtle links between religion and political beliefs in a critically important Muslim democracy.

The Politics of Islamic Law


Book Description

In "The Politics of Islamic Law" political scientist Iza Hussin offers a genealogy of contemporary Islamic law, a political analysis of elite negotiations over religion, state, and society in the British colonial period, and a history of current Muslim approaches to law, state, and identity. Hussin argues that Islamic law as it is legislated and debated throughout the Muslim world today is no longer the "shari ah" as it previously existed. She shows that shari ah an uncodified and locally administered set of legal institutions and laws with wide-ranging jurisdiction was transformed (not eradicated as some have argued) during the British colonial period into a codified, state-centered system with jurisdiction largely limited to law regarding family, personal status, ethnic identity, and the private domain. As a result, the practices, beliefs, and possibilities inherent in law, changed, and so did the strategies, attitudes and aspirations of those who used this changing system. Its present institutional forms, its substantive content, its symbolic vocabulary, and its relationship to state and society in short, its politics are built upon foundations laid during the colonial encounter, in struggles between local and colonial elites. "The Politics of Islamic Law" undertakes a cross-regional comparison of India, Malaya, and Egypt which illustrates that Islamic law is a trans-global product shaped by local political networks. The rearrangement of the local elite combined with the new reach of the state made possible by colonial power gave local elites a vested interest in this twinning of the centrality of Islamic legitimacy and the marginalization of its legal content. These processes are traced through close examinations of debates over jurisdiction, the definition of Islamic law, and in turn the nature of the state. This work makes an important contribution to critical debates in comparative politics, history, legal anthropology, comparative law, and Islamic studies."
