Excerpt from The Assessors, Collectors and Town Clerk's Manual: Containing a Full and Accurate Exposition of the Law Relating to the Powers and Duties of These Officers, With an Appendix of Forms The fence viewers, or either of them, shall have power to issue process for such witnesses as may be desired by either party, and to administer oaths to all witnesses produced before them. Id. In case the owner does not appear within a pre scribed time the statute authorizes the timber to be sold, and directs that a portion Of the proceeds be paid to the owner of the lands for damages. But it provides, that, before such money be paid, such dam ages shall be assessed by any two fence viewers of the city or town, and a specification thereof, signed by such fence viewers, shall be filed in the office of the clerk Of the city or town. 1 R.
