Law and Employment analyzes the effects of regulation and deregulation on Latin American labor markets and presents empirically grounded studies of the costs of regulation. Numerous labor regulations that were introduced or reformed in Latin America in the past thirty years have had important economic consequences. Nobel Prize-winning economist James J. Heckman and Carmen Pagés document the behavior of firms attempting to stay in business and be competitive while facing the high costs of complying with these labor laws. They challenge the prevailing view that labor market regulations affect only the distribution of labor incomes and have little or no impact on efficiency or the performance of labor markets. Using new micro-evidence, this volume shows that labor regulations reduce labor market turnover rates and flexibility, promote inequality, and discriminate against marginal workers. Continuity Despite Change

As the dust settles on nearly three decades of economic reform in Latin America, one of the most fundamental economic policy areas has changed far less than expected: labor regulation. To date, Latin America's labor laws remain both rigidly protective and remarkably diverse. Continuity Despite Change develops a new theoretical framework for understanding labor laws and their change through time, beginning by conceptualizing labor laws as comprehensive systems or "regimes." In this context, Matthew Carnes demonstrates that the reform measures introduced in the 1980s and 1990s have only marginally modified the labor laws from decades earlier. To explain this continuity, he argues that labor law development is constrained by long-term economic conditions and labor market institutions. He points specifically to two key factors—the distribution of worker skill levels and the organizational capacity of workers. Carnes presents cross-national statistical evidence from the eighteen major Latin American economies to show that the theory holds for the decades from the 1980s to the 2000s, a period in which many countries grappled with proposed changes to their labor laws. He then offers theoretically grounded narratives to explain the different labor law configurations and reform paths of Chile, Peru, and Argentina. His findings push for a rethinking of the impact of globalization on labor regulation, as economic and political institutions governing labor have proven to be more resilient than earlier studies have suggested.




Company Towns in the Americas

Company towns were the spatial manifestation of a social ideology and an economic rationale. The contributors to this volume show how national politics, social protest, and local culture transformed those founding ideologies by examining the histories of company towns in six countries: Argentina (Firmat), Brazil (Volta Redonda, Santos, Fordlândia), Canada (Sudbury), Chile (El Salvador), Mexico (Santa Rosa, Río Blanco), and the United States (Anaconda, Kellogg, and Sunflower City). Company towns across the Americas played similar economic and social roles. They advanced the frontiers of industrial capitalism and became powerful symbols of modernity. They expanded national economies by supporting extractive industries on thinly settled frontiers and, as a result, brought more land, natural resources, and people under the control of corporations. U.S. multinational companies exported ideas about work discipline, race, and gender to Latin America as they established company towns there to extend their economic reach. Employers indeed shaped social relations in these company towns through education, welfare, and leisure programs, but these essays also show how working-class communities reshaped these programs to serve their needs. The editors’ introduction and a theoretical essay by labor geographer Andrew Herod provide the context for the case studies and illuminate how the company town serves as a window into both the comparative and transnational histories of labor under industrial capitalism.




The Business of Empire

The link between private corporations and U.S. world power has a much longer history than most people realize. Transnational firms such as the United Fruit Company represent an earlier stage of the economic and cultural globalization now taking place throughout the world. Drawing on a wide range of archival sources in the United States, Great Britain, Costa Rica, and Guatemala, Colby combines "top-down" and "bottom-up" approaches to provide new insight into the role of transnational capital, labor migration, and racial nationalism in shaping U.S. expansion into Central America and the greater Caribbean. The Business of Empire places corporate power and local context at the heart of U.S. imperial history. In the early twentieth century, U.S. influence in Central America came primarily in the form of private enterprise, above all United Fruit. Founded amid the U.S. leap into overseas empire, the company initially depended upon British West Indian laborers. When its black workforce resisted white American authority, the firm adopted a strategy of labor division by recruiting Hispanic migrants. This labor system drew the company into increased conflict with its host nations, as Central American nationalists denounced not only U.S. military interventions in the region but also American employment of black immigrants. By the 1930s, just as Washington renounced military intervention in Latin America, United Fruit pursued its own Good Neighbor Policy, which brought a reduction in its corporate colonial power and a ban on the hiring of black immigrants. The end of the company's system of labor division in turn pointed the way to the transformation of United Fruit as well as the broader U.S. empire.
