Project Financing: Financial Instruments And Risk Management

Book Description

The book describes the different tools and techniques available to anyone who is engaged in providing funding or advice to a project. Project finance is ultimately about applying three basic principles to a funding situation and from these three, all the other ideas flow including contracts. First, there needs to be a cash flow coming from the project that is capable of being captured by finance providers. Second, there needs to be a group of assets that can be segregated and contained by making sure they cannot be taken away by other parties and thirdly there needs to be a risk envelope that is well understood and managed dynamically during the project's life. To do this, a network of contracts must exist to support the rights of the different stakeholders and their legal claims on the project. In this book the authors examine all of these aspects and provide some examples/mini-cases of project structures and approaches. The book begins and ends with a longer case study of two projects that were standalone examples of project financing and controversial for different reasons at the time of their fundraising.Bundle Set: Project Financing (Analyzing and Structuring Projects & Financial Instruments and Risk Management)

International Taxation of Cross-border Leasing Income

Book Description

This book discusses the practical issues faced by the banks, financial institutions, companies engaging in leasing as a form of asset financing, and their tax advisers. The book elaborately deals with the divergent tax treatment in the five most important leasing jurisdictions (ie, US, Japan, Germany, UK and Netherlands) in respect of transaction characterization, depreciation, income-recognition and anti-avoidance rules, as well as divergence in the relevant bilateral tax treaty provisions. Further, the book investigates how the parties to a cross-border leasing transaction may obtain tax advantages due to such divergent tax treatments, and whether and to what extent the general or specific anti-avoidance rules in the jurisdictions may neutralize the tax arbitrage opportunities. Finally, it examines how the framework of the EC Treaty may be relevant for cross-border leasing transactions between the EC Member States.

Leasing Public Land

Book Description

Leasing public land has been advocated as a viable land tenure option for former socialist countries and other transitional economies. However, the debate about land tenure has been influenced more by ideology and preconceptions than by lessons drawn from careful study of existing leasehold systems. This new publication offers a thorough examination of public leasehold systems around the world and presents insightful recommendations for the future role of such systems. Leasehold is a flexible form of land tenure that can be designed to provide an ongoing stream of revenue to finance public infrastructure. What is crucial to the success of leasehold systems is the design and development of appropriate institutions and organizations to, among other things, clearly define property rights and values and provide for effective administration.
