This is the first annual report submitted by the Comptroller General under Section 6, Public Law 96-517, commonly referred to as 'The Patent and Trademark Amendments of 1980.' Section 6 establishes a uniform policy for assigning title to inventions made by small business or nonprofit contractors during Government-sponsored research. The section also requires the General Accounting Office to monitor and report on the execution of the Act. This report describes the events leading to the passage of Public Law 96-517 and discusses actions taken to put the Act into effect. The report also contains a copy of Section 6 of Public Law 96-517 (appendix I) and a copy of Office of Management and Budget (OMB) Circular A-124, which sets forth regulations for carrying out the law (appendix II). As required by the Patent and Trademark Amendments of 1980, GAO reviewed the actions taken by Federal agencies to implement the Act's guidelines which establish a uniform policy for assigning titles to inventions by small businesses or nonprofit contractors during Government-sponsored research. Under the provisions of the Act, GAO is responsible for monitoring how well the guidelines are being enacted and for determining whether an agency determination is contrary to the Act's policies and objectives. It is too early to draw any conclusions about the guidelines; however, preliminary assessments of agency actions and the regulations issued to put the law into effect promise that the goal of uniformity may be achieved.
