PATENTING A NEW PRODUCT. THERE are three forms of direct patent protection which it is possible to use to obtain a monopoly of a product and one form of indirect protection. The first and best protection would be that of a patent on the product itself. In order to obtain a patent on the product the product must be new. If the product is one which is covered by a patent, but for which the patent is about to expire, it would not be sufficient merely to make a slight improvement, because the patent would cover only jthe improvement. The form of the product covered by the original patent would be public property and anyone could make or use or sell it. It is quite often supposed that by getting a new patent, not only is the improvement covered, but the elements of the product which were the subject of the first patent are also protected. I have shown in the fourth chapter, under the heading "Avoiding Infringement by Omitting an Element of the Claim," that to omit an element of a claim without substituting any equivalent is to avoid the claim. Thus, if the improved product had five elements, A, B, C, D, and E, and the product as covered by the original patent had only four of these elements, A, B, C, and D, the patent on the improvement would cover the use of only the elements, A, B, C, and D, without the element E; and, moreover, the second patent, if it had the effect of covering the product of the first patent, would be void because it covered what must become public property at the expiration of the first patent. Patent Rights and Economic Growth


Book Description

The objective of patent rights is to foster innovation and economic growth. However, to date, there is little robust evidence that patents ldquo;workrdquo; as intended. Here, we study the impact of changes in effective patent rights within panels of up to 54 manufacturing industries in up to 72 countries between 1981-2000. We find that more patent-intensive industries responded to stronger patent laws with higher growth, which effect increased with GDP per capita. Between 1991-1995, an increase in the level of effective patent rights from Hong Kong to Australia would have raised the average growth of the leather industry by 1/18, but that of the other chemicals industry by about 1/5. Patent rights increased growth through both factor accumulation and raising productivity. Our findings were robust to alternative measures of patent rights and patent intensity.




Protecting Their Intellectual Assets

Based on a survey questionnaire administered to 1478 R & D labs in the U.S. manufacturing sector in 1994, we find that firms typically protect the profits due to invention with a range of mechanisms, including patents, secrecy, lead time advantages and the use of complementary marketing and manufacturing capabilities. Of these mechanisms, however, patents tend to be the least emphasized by firms in the majority of manufacturing industries, and secrecy and lead time tend to be emphasized most heavily. A comparison of our results with the earlier survey findings of Levin et al. [1987] suggest that patents may be relied upon somewhat more heavily by larger firms now than in the early 1980s. For the protection of product innovations, secrecy now appears to be much more heavily employed across most industries than previously. Our results on the motives to patent indicate that firms patent for reasons that often extend beyond directly profiting from a patented innovation through either its commercialization or licensing. In addition to the prevention of copying, the most prominent motives for patenting include the prevention of rivals from patenting related inventions (i.e., patent blocking'), the use of patents in negotiations and the prevention of suits. We find that firms commonly patent for different reasons in discrete' product industries, such as chemicals, versus complex' product industries, such as telecommunications equipment or semiconductors. In the former, firms appear to use their patents commonly to block the development of substitutes by rivals, and in the latter, firms are much more likely to use patents to force rivals into negotiations.
